November 22, 2022 LICENSEE: PSEG Nuclear LLC FACILITY: Hope Creek Generating Station

SUBJECT:

SUMMARY

OF NOVEMBER 17, 2022, PRE-SUBMITTAL PUBLIC MEETING WITH PSEG NUCLEAR LLC TO DISCUSS THRESHOLD DETERMINATION ON TRANSFERRING OWNERSHIP OF PORTIONS OF THE SITE (EPID L-2022-LRM-0090)

On November 17, 2022, an observation public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of PSEG Nuclear LLC (PSEG or the licensee) by teleconference. The purpose of the meeting was to discuss PSEGs plans to submit a forthcoming Threshold Determination letter associated with transferring ownership of portions of the site to a PSEG subsidiary. The meeting notice and agenda, dated November 3, 2022, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML22307A187. A list of attendees is enclosed.

The licensee presented an overview of New Jersey Wind Port Project, the purpose for the upcoming Threshold Determination submittal, and a diagram of PSEG Nuclear Site (ML22319A243). The licensee also provided the following justifications as to why the proposed land transfer to an affiliate does not involve a license transfer:

The land to be transferred to an affiliate company is wholly owned by PSEG Power.

PSEG Nuclear would maintain access and authority to do whatever is necessary to maintain safety and security for the nuclear sites.

There would be no change to the ownership of the nuclear plants; rather, only the land within the site boundary would be changing.

There would be no impact to the operation or management of the nuclear plants.

There would be no change in the technical or financial resources available to PSEG Nuclear.

There would be no impact to decision-making regarding any aspect of nuclear operations.

During the meeting, the NRC staff stated that it agrees with the licensees assessment of not requiring a license transfer regarding the proposed land transfer to an affiliate. However, the NRC staff stated that it needs to review the upcoming Threshold Determination submittal in detail to determine any impact on the exclusion boundary area and a need for an indemnity amendment.

There were no comments from members of the public. No public meeting feedback forms were received.
