  • 4 I ' 2 c MINUTES OF THE FOUR HUNDRED FORTY-FIRST MEETING OF THE ADVISORY COMMITTEE ON REACTOR SAFEGUARDS MAY 1-3, 1997 ROCKVILLE, MARYLAND The 441st meeting of the Advisory Committee on Reactor Safeguards was held in Conference Room 2B3, Two While Flint North Building, Rockville, Maryland, on May 1-3, 1997. The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda. A portion of the meeting was closed to discuss information of a personal nature, the release of which would constitute a clearly unwarranted invasion of personal privacy. The rest of the meeting was open to public attendance.

There were no written statements nor requests for time to make oral statements from members of the public regarding the meeting.

A transcript of selected portions of the meeting was kept and is available in the NRC Public Document Room at the Gelman Building, 2120 L Street, N.W., Washington, D.C. I. CHAIRMAN'S REPORT (Open)

(Note: Dr. John T. Larkins was the Desigrated Federal Official for this portion of the meeting.)

Dr. Robert L. Scale, Chairman of the ACRS, convened the meeting at 0:30 a.m. and reviewed the schedule for the meeting. He announced that two new staff members had joined the ACRS/ACNW Office and that a number of NRC management changes had occurred since the last ACRS meeting. Dr. Seale also mentioned an article in the magazine Nuclear Professional concerning high-burnup fuels.

II. Desian-Basis Verification (Open)

Mr. John Barton, Chairman of the ACRS Subcommittee on Plant Operations, introduced the topic to the Committee. He stated that the purpose of the briefing was to review the staff

441st ACR5 Meeting 2 May 1-3, 1997 criteria for evaluating licensee responses to the NRC request for design basis information pursuant to 10 CFR 50.54 (f) . He noted that the NRC had requested these actions, in part, due to ' insights realized f rom the special inspection of engineer-ing and licensing at the Haddam Neck station and from the findings- of the Millstone Lessons Learned Task Group. He introduced Marylee Slosson, Acting Director, Division of Reactor Program Management, NRR.

NRC Staff PresentatioD Ms. Slosson introduced the NRC staff. Mr. Robert Gallo,-

Chief, Special Inspection Branch, NRR, and Mr. David Solorio, Reactor Systems Engineer, Generic Issues and Environmental Projects Branch, NRR, led the discussions for the NRC staff.

Significant points made during the discussion include:

Design Inspections Mr._Gallo summarized the purpose of the design inspections, the results of those inspections, and associated conclusions.

He noted that the design inspection eifort had begun in parallel with the letters regarding 10 CPR 50.54 (f) . Signifi-cant points made during the discussion include:

  • The purpose of the design inspections is to evaluate the-capability of the systems selected to perform safety functions required by the design basis, adherence of the design and licensing basis, and consistency of the as-built configuration to the Final Safety Analysis Report; e The initial selection of plants was_ based on the overall p1 Gut performance, the age or-licensing vintage of the plant, and input from regional NRC management.

e At. most plants,_ two systems are evaluated using a

" vertical slice" method which means looking from top to bottom (e.g. , mec%nical, electrical, instrumentation and  ;

controls,.etc.) for the various components, interfaces, and support systems, o Risk insights-are integrated in system selection. The staff looks-at the licensee's Individual Plant Examina-tion (IPE) or Probabilistic Risk Assessment (PRA) to better focus the inspection.

e To.date, the inspections have identified generic issues-including problems associated with interpretations of the licensing basis, control of calculations,.and discrepan-cies in licensee Final Safety Analysis Reports (PSAR).

Review of Licensee 10 CFR 50.54 (!) Responses Mr. Solorio summarized the history of concerns regarding the adequacy of plant design basis information, reviewed the actions and information requested in the 10 CFR 50.54 (f) letters sent to all licensees, discussed the approach and criteria for evaluating licensee responses, and highlighted preliminary results of the staf f review and proposed follow-up actione. Significant points made during the discussion includes e NRC concerns regarding the adequacy of design basis information began in the early 1980s and the staff proposed to develop a Generic Letter to address these concerns. However, the NRC did not issue this document based c n voluntary industry initiatives. The findings at Millstone highlighted the need for the NRC to take stronger action and the 10 CFR 50.54 (f) letters were sent to the Chief Executive Officers of each utility in October 1996.

  • All licensees were requested to provide a description of their engineering design and configuration control processes; a rationale for concluding that the design-bases have been translated into station procedures; a rationale concluding that systems, structures, and components are consistent with the design; processes to assure problem identification and corrective action, determine the extent of problems and actions to preclude recurrence; and to confirm the ef fectiveness of programs and processes to ensure that plant configuration is consistent with the design bases, o The staff developed a 4-phase approach to reviewing and evaluating licensee submittals where the following actions would be expected:

Phase 1: The responsible NRR licensing project manager (PM) performs a prompt acceptance review to identify issues of significant regulatory concern.

Phase 2: A pilot evaluation of one plant per region (pilot review) is performed using the evaluation template (Attachment 1 to the memorandum) to identify areas where additional regulatory oversight of licensee design controls may be warranted.

and the results of NRC inspections (including design basis inspection), updated FSAR reports and license amendment requests, enforcement, and information in the Plant Issues Matrix. The results of these reviews will be discussed during semi-annual Plant Performance Reviews i for the Senior Management Meeting screening meetings.

! Industry Presentation 4 i

Mr. Adrian Heymer of the Nuclear Energy Institute (NEI) provided a brief discussion of the industry's activities in the area -of design basis verification. He summarized the overall impact of the NRC 10 CFR 50.54 (f) letters on industry

- resources, reviewed past industry initiatives for design basis reconstitution, and discussed NEI guidance documents regarding these matters. Significant points made during the discussion ,

include:

  • In October 1996, an industry initiative resulted in development of NEI 96-_05, " Guidelines for Assessing
Programs for Maintaining the Licensing Basis," to assist
licensees in preparing responses to the NRC 10 CFR 50.54(f) letter.

e Two. industry meetings were held with the NRC in October ,

.1996 to discuss the requested information subject- to the

-- 10 _ CFR 50. 54 (f) letters. The industry estimates that each response, on average,: costs about 2,000 staff hours 4 per licensee.

  • NEI contends that erah design inspection also costa each licensee about 10,000 billeole hours and that the findings tend to focus on pape c and documentation rather than <-fety issues.

e In January 1997, NEI formed a Design Basis Task Force to support an integrated industry response and to refocus industry efforts on NUMARC 90-12, " Design Basis Program Guidelines." The Task Force plans to amend NUMARC 90-12 to clarify terminology (e.g., design, design bases, design control, configuration control, etc.) and f acili-tate better industry understanding and implementation.

Dr. Apostolakis questioned whether the inspection findings had identified issues that changed the probabilities assumed in licensee IPEs and PRAs. The staff stated that the more significant findings are usually identified in Licensees Event Reports and that these reports are inputs to the NRC accident sequence precursor program which is also used by licensees.

The staf f stated that the inspections focus more on operabili-ty issues than on risk studies. The staf f reiterated that the licensee IPE/PRAs are used to select systems to be inspected but noted that the inspectors move on to the next assignment when the report is completed.

Drs. Apostolakis, Seale, and Powers questioned how inspection results are shared with other NRC of fices to evaluate PRA assumptions. The staf f stated that its process for evaluating operating experience highlights appropriate events / incidents for risk evaluation. However, the staff acknowledged that a formal mechanism has not been specified for these inspections and reviews.

Dr. Powers questioned the effects of licensee cost cutting measures on engineering organizations and technical capabili-ty. The staff stated that it is a potential concern but indicated that the question could not be answered based on the current effort.

Drs. Scale and Powers expressed favorable views regarding the design inspection ef fort and noted that these inspections were identifying important safety issues which were not being self-identified by licensees. They expressed belief that the four-phase approach was effective in identifying licensees that need to take action.

At the conclusion of the briefing, Mr. Barton stated that the ACRS planned to prepare a report to the Commission regarding this matter.

also stated that the Executive Director for Operations (EDO) 4 had requested formal ACRS comment on the result of the

[ the Policy Statement, NRR noted that it describes the Agency's expectations for. and intended approach to power reactor licensees as the industry moves toward more open competition, d

Specific areas of concern include: NRC responsibilities vis-a-vis State and Federal regulators; co-owner division of responsibility; and financial qualification, decommissioning funding assurance, and antitrust reviews.

Aside from the above Policy Statement, activities associated with the NRC Action Plan include the following: issuanceHof i draf t Standard Review Plans on antitrust, ' financial qualifica-tions, and decommissioning funding assurance; securing staff-level liaison activities with State and Federal rate regula-tors; issuance of advance notice of proposed rulemaking regarding decommissioning funding assurance; issuance of Administrative' Letters-.to all owners of nuclear power plants (NPPs) requesting Agency notification of- any financial' restructuring _ actions; and plans to adopt an initiative of the Financial Accounting - Standards Board regarding a periodic reporting requirement on the status of a licensee's decommis-sioning fund.

e Dr. Powers urged NRR to reevaluate the tone of the language in the Policy Statement as- it applies to invoking " joint-and-several" financial liab:,lity to r

e The NRC is reevaluating the need to conduct antitrust reviews, in light of duplication of such reviews by other Federal Agencies (e.g. , Department of Justice) .

  • NRR indicated that inputs used to perform decommissioning cost estimates have not been updated since the late-1970s.

Prior to recess, Dr. Seale asked that the NRC staff keep the Committee informed on this general topic, especially when it believes ACRS input is needed.

Dr. Dana Powers, Vice-Chairman of the ACRS, introduced this topic to the committee and noted that the ACRS had previously reviewed this matter in October 1995. He stated that proposed final Regulatory Guide 1.164, " Time Response Design Criteria for Safety-Related Operator Actionu," was reissued for public comment in response to ACRS concerns noted in its report dated November 14, 1995. Regulatory Guide 1.164 endorses industrial standard ANSI /ANS-58.8-1994, of the same title. . He also noted that ANSI /ANS-58.8-1994 was different from most industrial standards in that part of the technical bases is proprietary andi-therefore, is not available for public review.

Dr. Powers stated that the staff.had not yet completed its review of this matter and would be providing a status report

NRC Staff Discussion 1 Mr. Jay Persensky, Acting Chief, Control, Instrumentation and Human Factors Branch, DST /RES, led the discussions for the NRC ,

staff. Mr. Cecil Thomas, Chief, Human Factors Assessment i Branch, NRR, provided supporting discussion. Mr. Rick Hill of

- the General Electric Company also participated. The. staff did not make a formal presentation and stated that a letter from the ACRS was not requested at this time. The staff provided ,

an overview of the activities regarding this matter and high)ighted the following points:

e The staff plans to provide the proposed final Regulatory Guide for ACRS review af ter integrating insights from the NRC initiatives (i.e. , Standard Review Plan sections and '

associated Regulatory Guides) for risk-informed, perfor-mance-based regulation.

e The staff also plans to consider information realized from the NRC IPE Insights Report (NUREG-1560) and from ,

empirical studies on human performance from the Halden Project. 1 e ANSI /ANS-58.8-1994 is an update to the earlier 1984 industrial standard. ,

Dr. Powers questioned what applications this Standard might have in meeting the NRC regulations. The staff stated that some licensees have taken credit for operator actions, where equipment is degraded, as a basis for declaring equipment operable. The staff provided the Committee with a list of situations where the staff has encountered licensees using or taking credit for provisions of the Standard.

At the conclusion of the meeting, Dr. Powers requested the staf f to address the following points during the next briefing on this matter e The rationale for how the Standards Committee developed consensus and how the experts arrived at conclusions.

  • - Why a peer review was not completed and how one might be done.
  • Applicability of the Standard for advanced reactors.

V. Reaulatorv Effectiveness (Note: Dr. M. El-Zeitawy was the Designated Federal Official for this portion of the meeting.)

Introduction Dr. Robert L. Scale, Chairman of the ACRS, welcomed Mr. Edward L. Jordan, Deputy Executive Director for Operations. Dr.

Seale stated that the NRC is developing a regulatory offec-tiveness program to independently assess the regulation of reactor and materials licensees. The program goal is to improve NRC's regulateely oversight of licensees.

NRC Presentation Mr. Jordan noted that Mr. Thomas O. Martin had been appointed Chairman of the Regulatory Effectiveness Task Force. As part of the strategic assessment and rebaselining project, Direc-tion Setting Issue #23 addressed the enhancement of regulatory excellence. In addition, COMSECY 067 asked for a compre-hensive, systematic, agency-wide approach to program assess-ment and improvement.

The concept of the regulatory ef fectiveness program is to proceed on three parallel paths for identification of weak-nesses and feedback of constructive recommendations to NRC.

These paths are:

e Independent review program to be developed and implement-ed by the Regulatory Effectiveness Assessment Staff (REAS) e Develop and maintain a regulatory matrix assessment tool (REGMAT) by the Office of Nuclear Regulatory Research (RES) e Compile and develop performance information by the Of fice of Analysis and Evaluation of Operational Data (AEOD),

Of fice of Investigation (OI), Office of Enforcement (OE),

and RES. -

t The REAS would focus on the technical aspects of NRC activi-ties. The objective is to improve the clarity, coherency, consistency, focus on risk, and technical quality of NRC regulatory activities. This would result in improving public cor.fidence in NRC activities. The initial REAS development will f ocus on power reactors. A program will be developed for other licensees beginning mid-FY98. Site-focused assessments will build upon lessons learned from Millstone and Maine Yankee ef forts. The in-of fice assessments will focus on areas such as license amendments, exemptions, and safety issue follow-up. Findings will be provided in a report f rom REAS to the EDO. The EDO will issue action assignments to applicable program offices to address findings. REAS will follow up on action assignments.

The REGMAT will relate NRC regulations and processes to reactor licensee programs and hardware to determine whether areas have been appropriately examined, de-emphasized, or over-emphasized. The objective is to provide a systematic basis for nomination and selection of areas for assessment.

The REGMAT will be an evolving tool and RES will have the lead for its development.

The role of AEOD includes collecting and analyzing regulatory

- effectiveness assessment information and providing input to REAS of assessment areas and potential regulatory effective-ness findings. The role of OE includes developing regulatory effectiveness insights from the enforcement process and providing insights on licensee performance to NRR and the Regions. The role of OI includes developing insights of licensee and NRC performance through the conduct of investiga-tions and providing insights on licensee and industry perfor-mance. The role of RES includes developing the REGMAT and workplace environment and safety attitude assessment tool with the input of potential assessment areas to AEOD and REAS based on an analysis of RES programs (such as IPE/IPEEE).

The REAS consists of one SES manager, four technical staff, and one clerical person. The REAS will develop a Commission policy statement on the principles of regulatory ef fectiveness assessment and will develop a prioritized list of regulatory effectiveness assessment areas.

The ACRS met with the NRC Commissioners on May 2, 1997, in the One White Flint North Building, Rockville, Maryland.

The NRC Commissioners were briefed by and held discussions with the Committee on the following topics:

e Risk-informed, performance-based regulation and related matters; e Risk-based regulatory acceptance criteria for plant-specific application of safety goals; e Proposed regulatory approach associated with steam generator integrity; e Establishing a benchmark on risk during low-power and shutdown operations; e Status of ACRS review of the National Academy of Scienc-es/ National Research Council Phase 2 Study Report on digital instrumentation and control systems; e Human Performance Program Plan; and e ACRS report to Congress on Nuclear Safety Research and Regulatory Reform.

Cpnclusion The May 27, 1997, Staff Requirements Memorandum (SPM) result-ing from this meeting is attached as Appendix VI.

VII. Staff Recuirements Memorandum on Directicn Settina Issue 22.

Dr. Dana Povers, who led the discussion, stated that the Of fice of Nuclear Regulatory Research (RES) had been providing a significant part of the Commission's independent technical capability since the NRC was established in 1975. Congress, in the Energy Reorganization Act of 1974, mandated the

441st ACRS Meeting 12 May 1-3, 1997 formation of RES to ensure that the Commission would have "an independent capability for developing and analyzing technical safeguards, and information related to reactor safety, environmental protection in support of the licensing and regulatory process."

Direction Setting Issue (DSI) #22 raises the issue of what role RES will have in the future. A range of possibleThe roles research is defined in the discussion of this DSI.

program includes both a longer " exploratory" research compo-nent and a " con f i rma't.ory " research component of a shorter duration that is based primarily on requirements specified by NRC's program of fices in user need memoranda. This last category comprises approximately 80 percent of the current research program.

The research options in DSI#2 are as follows:

Option 1 - quit performing research Option 2 - confirmatory research only option 3 - exploratory research only option 4 - confirmatory and exploratory research Option 5 - establish and maintain core research capabilities Option 6 - use universities more Option 7 - participate 4.n international safety programs In an SRM dated March 28, 1997, the Commission approved Options 4 and 5. In addition, the Commission supported a bigger fraction of the research to be performed at universi-ties and encouraged active participation in international research programs. The SRM also stated that other items to be performed and discussed included:

  1. Erplore cooperative research with industry and the Department of Energy (DOE)

O Move rulemaking out of RES

  • Establish a Research Effectiveness Review Board e Identify research needs for NRC oversight of DOE nuclear facilities

441st ACRS Meeting 14 May-1-3, 1997 Introduction Dr. Thomas Kress, acting Chairman of the Maintenance Practices and Procedures subcommittee, introduced the topic to the Committee. Dr. Kress stated that the purpose of this presen-tation was to brief the Committee regarding the results and lessons learned from the implementation and initial baseline inspections of the Maintenance Rule. He further stated that this briefing was for information only and no Committee report was required.

HRC Staff Presentation The staf f brief ed the Committee on the background, implementa-tion, and lessons learned from the baseline inspections of the Maintenance Rulo. The Maintenance Rule, 10 CFR 50.65,

" Requirements for Monitoring the Ef fectiveness of Maintenance at Nuclear Power Plants," was issued on July 10, 1991, to be effective on July 10, 1996. Specifically, it consists of requirements that establish which structures, systems, and

. components (SSCs) are included within the scope of the rule, requirements for monitoring the performance or condition of those SSCs within the scope of tne rule, and a requirements that licensees periodically assess maintenance ef fectiveness.

The staff has conducted 24 baseline inspections. In general, the staf f f ound that licensees have adequately implemented the requirements of the Maintenance Rule. Of the 18 baseline inspections for which enforcement actions with a Severity Level IV violation, one resulted in escalated enforcement at Severity Level III but no civil penalty, and three had no maintenance rule violations. For the remaining inspections, the enforcement actions are under evaluation by the staff.

The implementation and initial baseline inspections have provided the NRC staff with a number of lessons regarding what was offective and what could improved. These lessons can be grouped into four categorieat importance of communication, value of the pilot program, importance of training, and importance of inspection and enforcement.

1) COMMISSIONERS' VIEWS ON DIRECTION SETTING ISSUES (Open)

The committee was provided with copies of each Commis-sioner's positions on the various Direction Setting Issues (DSIs). In addition to other items, Commissioner McGaffigan will discuss his views on the role of NRC research during his meeting with the ACRS in July 1997.

RECOMMENDAHQH The Subcommittee recommended that the Members f amiliarize themselves with Commission positions on the DSIs and particularly on DSI 22 regarding the NRC Research Program, as this program will be the subject of future Committee discussions.

2) STATUS OF APPOINTMENT OF MEMBERS (Closed)

The Commission has approved, subject to the normal background check, the selection of Dr. Robert Uhrig as a Member of the ACRS. Individual Commissioners did vote for other candidates; however, no one else received the necessary three votes to be appointed to the Committee.

The ACRS Executive Director and his deputy, with support from the Operations support Branch, have formulated a proposed budget for the ACRS and ACNW for fiscal years 1998 through 2001. The budgnt consiste of a workload forecast, planned accomplishments, a multi-year implemen-tation plan, prioritization of work and an information technology budget. No increase is requested in the budget for FY 1998, but a modest increase in the budget for FY 1999 through FY 2001 has been : equested, mainly in anticipation of review activities in the area of NRC oversight of DOE facilities.

RECOMMENDATION The Subcommittee recommended that the Executive Director

- review the budget package with the Planning and Proce-dures Subcommittee membern.

4) CONCERN REGARDING THE Dill)sCT CONTAlliMENT HEATING (DCll)

ISSUE RESOLUTION (Open)

A former employee at Sandia National Laboratory raised a concern with T. Kreos, .\CRS, on the resolution of the DCH issue by the NRC. As the emp3oyee does not work for NRC or a contractor, it does not appear that he can use the Differing Professional Opinion (DPO) process. However, his concerns should be brought to the attention of the ACRS and be acted on. Dr. Kress would like to discuss how the ACRS should address this issue.

RECOMMENDATION The Subcommittee recommended that the Chairman send a letter to the EDO recommending that thn Staf f review the employee's concerns and keep the Committee informed on the resolution of this issue. The employee will be notified of this Committee action.

5) ACRS FELLOWS SAFETY REPORT OF THE RESOLUTION OF GENERIC ISSUES (Open)

One of the assignments made at the October 17-19, 1996 Boston meeting of the Regulatory Policies and Practices Subcommittees was that ACRS Fellows be given the task of assessing the effectiveness of the NRC process of resolving generic safety issues. Gus cronenburg subse-quently reviewed a limited set of generic safety issues and presented results of his analyses in a report dated March 1997. Dr. Powers has requested that the Planning and Procedures Subcommittee discuss the matter and make recommendations as t o what additional actions should be taken.

RECOMMENDATION The Subcommittee recommended that this matter be dis-cussed by the full Committee and that Gus cronenburg be asked to continue to look for risk-significant generic safety issues that have not been adequately addressed by the NRC Staff.

6) USE OF COPYRIGHTED MATERIAL IN ACRS REPORTS (Open)

The Committee should be careful to avoid the use of copyrighted material as attachments to its reports. Use of copy righted material requires approval for release and should be avoided.

RECOMMENDATION The Subcommittee recommended that Members be vigilant in avoiding the use of proprietary and copyrighted material in their reports.

7) OUADRIPARTITE MEETING (Open)

Af ter discussions with the German RSK and French GPR Committees, agreement has been reached on the date for the Quadripartite Meeting, based on the suggested dates of fered by the Japanese hosts. The dates agreed upon are January 19-23, 1998.

RECOMMENDATION The Subcommittee recommended that a letter be addressed to Dr. Togo indicating our agreement with the January 19-23, 1998, date, and requesting that a final agenda be developed as soon as possible.

8) MEMBERS' ISSUES (Open) e Dr. Powers raised the question of ACRS review of Emergency Operating Procedures as a result of the steam generator dryout event at ANO-1 (IF 97-06).

The event was exacerbated by an out-of-date emer-gency operating procedure.

RECOMMENDATIOU The Subcommittee recommended that the EDO be asked to indicate what efforts have been made to ensure that Emergency Operating Procedures are kept up-to-date, o Dr. Powers suggested that the ACRS Report to Con-gress on the NRC Research Program be given wider distribution; for example, it could be sent to the Administration and to the Chairman and members of the Senate and House Committees that oversee NRC activities.

RECOMMENDATION The Subcommittee recommended that this subject be discussed by the Committee.

The Committec agreed to make a wider distribution of this report.

ACRS Report-to Congress on Nuclear Safety Research and Regulatory Reform The Commission encouraged the-ACRS to continue to provide its perspectives on issues important to the mission of the NRC, and to be forward-looking in bringing developing concerns to the Commission's attention in order to help ensure the NRC is

. prepared for future challenges. In particular, the Committee's work on acceptance criteria for plant-specific safety goals, and on deriving lower-tier acceptance criteria, is important for r consistency and traceability. Specifically, the Commission requested that-the ACRS determine the-change in CDF and LERF from site to site, when'these lower-tier criteria are derived from the prompt fatality quantitative health objectives.
