Governor Thompson formally subnitted the proper.a1 to Chaiman Zech on October 2,1986. An initial draft of the proposti wcs circulated to your office for review on August 12,1985(enclosure 1). On November 19, 1986 we informed you of the disposition of RES corraents on the draft proposal (enclosure 2). A redraft of the propose.1 was circulated for NRC staff coment on September 10,1986 (enclosure 3). No coments were received fron RES staff. The redrafted proposal incorporates RES' carlier corrr:nts.

DRAFT PROPOSAL FROM ILL15015 FOR ACREEMENT STATE STATUS Enclosed for your review and comment is a draf t proposal from lilinois
- for a 274b agreement with the NRC. The proposal includes the Program Stateacnt (Volume 1). Statutes (Volume 11). Regulations (Volene !!!), a draf t letter from the Governor and a draft agreement. The proposal covers byproduct material as defined in Section 11(e)(1) of the Atoiste Energy Act, source material. special aselear material in quantities not sufficient to form a critical mass and the land disposal of byproduct, source and special nuclear material covered by the agreement. The state will not be requesting authority to regulate byproduct asterial as defined ta 11(e)(2) of the Atomic Energy Act (sill tailings) for the present.
The approp-inte criteria for review of this proposal are those contained in the NRC Policy statement
- Criteria for Guidance of States and NRC in Discontinuance of NRC Regulatory Authority and Assumption Thereof by States Through Agreement" (c p/ enclosed). The State followed the Suggested State Regulations SSR) developed by the Conference of Radiation Control Program Directors in drafting its regulations. The latest 55R revision (1982) was approved by the NRC staff.

I Our understanding is that under the agreement 1111eois would assume regulatory control over the Sheffield law-level radioactive waste disposal site since the State is requesting authority to regulate low-level waste disposal. We would appreciate a statement from ELD regarding the procedures involved for treasferring the MC 19esese for Sheffleid to the State.
