Dear Mr. Boyd:

In a telephone conference call on September 28, 1978, between Mr. D. Tibbitts, NRC Project Manager, and representatives of Ohio Edison Company, Commonwealth Associates, Inc., and The Research Corporation (TRC) of New England, a discussion took place regarding the probability of un-acceptable conditions occurring in the control room as a result of a toxic chemical spill near the Erie Plant.

Differing interpretations on the use of Regulatory Guide 1.78, and concerning the appropriate methodology and data used in the analysis, resulted in an Ohio Edison agreement to redo this analysis using a different approach.

Although the reanalysis has been performed, the NRC staff has indicated through further discussions that the second analysis is not ac-ceptable. Areas of discord include the methodology used in the analysis and the lack of toxic chemical shipment data from the Norfolk and Western Railway Conpany.

Accordingly, we would like to propose the following:

1) Ohio Edison Company will make the necessary prcvisions in the design of the Erie Nuclear Plant to accommodate toxic chemical monitors and adequate isolation capability for the chemicals in _uestion such that they could be installed at a future date.
2) Ohio Edison Company will make additional attempts to secure the necessary data from Norfolk and Western.
3) Ohio Edison Company will resubmit to the NRC a hazards analysis for the toxic chemicals shipped past the Erie site by rail, at a future date between the issuance of a construc-tion permit and issuance of an operating license.

Boyd November 6, 1978 h) Should the analysis show that the rick from. certain toxic chemicals is unacceptable, Ohio Edison vill install the required monitors to detect the toxic limits of these chemicals and to automatically isolate the control room within an appropriate time period (e.g., 10 seconds for detection and isolation in the case of chlorine) from further intake of such chemicals.

5) In the case of chlorine, an additional provision in the design of the Erie Nuclear Plant will be made with respect to the outside air intake rate for the control room. If chlorine protection is required, the normal control room outside air intake rate vill be limited to less than one air change per hour as described in Regulatory Guide 1 95 Ohio Edison trusts that this proposal vill be found acceptable by your staff and that this commitment vill alleviate further delay in the issuance of the Safety Evaluation Report Supplement.
