Dear Mr. Baer:

Ohio Edison has reviewed your letter of January 31, 1979 (Reference 2) with our NSSS supplier, Babcock and Wilcox Company, and our A/E, Gilbert / Commonwealth Associates, Inc. Based upon our current understanding of the NRC's request, it is our position that any design and initial construction of the Eric Plant scheduled to occur between now and November 1, 1979, can proceed without precluding the addition of ATWS mitigating equipment, as outlined in References 1 and 2 above.

However, it should be noted that the final detailed requirements of the NRC are not known at this time, but will be established by November 1, 1979 (Reference 1). When these regulatory requirements have been finally established, Ohio Edison will determine what, if any, design modifications are needed for Eric Nuclear Plant.

Should the NRC increase its requirements for the mitigation of ATWS beyond those specified in References 1 and 2 above, for B&W plants, or should the NRC final rule / regulations on ATWS be issued after November 1, 1979, Ohio Edison cannot assure that the design and initial construction of Erie Plant would be such so as not to preclude their addition.
