On February 16, 1979, Applicants filed a motion seeking the dismissal of Intervenors Evelyn Stebbins and Coalition for Safe Electric Power. One of the grounds advanced for dismissal was that all of Intervenors' con-tentions had been previously dismissed by the Licensing Board. Applicants respectively request leave to draw the Board's attention to a recent and subsequent order of the Atomic Safety and Licensing Appeal Board which, we believe, bears directly on that issue presented in the motion..

, Atomic Safety and Licensing Board March 7, 1979 Page Two In Duke Power Comeanv, Docket No. 70-2623, ALAB-528 (February 26, 1979), the Appeal Board instructed the Licensing Board below to grant an intervention petition in a proceeding on the application for amendment of a special nuclear material license. The petitioner had presented only one contention, and the Appeal Board, at slip op. 9, n.10, observed that if the Licensing Board were to later find that the contention is invalid, the Licensing Board could then " dismiss (the intervenor] from the proceeding."
