Dear Members of the Board:

In late January, the NRC Staff issued its Supplement to the Safety Evaluation Report for the Erie Nuclear Plant, Units 1 and 2.

That Supplement sufficiently com-plates the Staff's evaluation to enable convening the radiological health and safety phase of the construction permit hearing.

Consideration of the financial qualifi-cations issue, deferred pending finalization of the construction schedule, would of course be postponed.

Pending issuance of the Staff's Environmental Impact Statement, a hearing on environmental issues wculd also be deferred.

POTTS & TRCWBRIDGE Atomic Safety and Licensing Board Page Two March 5, 1979 Accordingly, Applicants request that the Licensing Board establish a date for convening the radiological health and safety phase of the evidentiary hearing to determine Issues 1(a)-(d), 2 and 4 as specified in the Commission's Notice for Hearing, 42 Fed. Reg. 24775 (1977).

There are no intervenor contentions involving radiological health and safety matters, and Applicants know of no matters in controversy between Applicants and the Staff.

Thus, although this proceeding is contested in accordance with the definition in 10 C.F.R. Section 2.4 (n) because of the remaining environmental contentions, the re would be no matters in controversy to be litigated during the radiological health and safety phase of the proceedings.

Subject to the Licensing Board members' schedules, Applicants would propose that this phase of the hearing commence on April 10, 1979.

Counsel for the NRC Regulatory Staff has indicated no objection to proceeding with this phase of the hearing at that time.
