M95298 and M95299 By letter dated August 11, 1998, the NRC transmitted the draft i Safety Evaluation (SE) for the conversion to Improved Technical Specifications. The letter requested comments on the draft SE l and also requested that the licensee propose appropriate license  !

conditions for the relocated material from the current technical l specifications and for the scheduling of new more restrictive I requirements. Finally, the letter requested a certified copy of l the proposed Technical Specifications and Bases. Based on conversations with the NRC staff and Duke's internal -

review, additional information is provided concerning the draft SE. Enclosure 1 of this letter provides a revision to the proposed license condition as requested to address the scheduling l of new or revised surveillance requirements. Enclosure 2 of this l letter provides the changes necessary to the ITS submittal, as amended, to resolve items identified by Duke Energy during the review.

The proposed changes are administrative in nature and have been determined to be within the scope of the original PORC and NSRB ,

reviews.

Pursuant to 10 CFR 50.91(b) (1) , a copy of this amendment has been l provided to the appropriate State of South Carolina officials.

4 PROPOSED LICENSE CONDITIONS Section 2.C (2) of the Facility Operating License, NPF-35 and NPF-52, should be revised to include the following additional subparagraph:

For Surveillance Requirements (SRs) that are new in Amendment [ ] to Facility Operating License NPF-35 (NPF-52 for Unit 2}, the first performance is due at the end of the first surveillance interval that begins at implementation of Amendment [ -]. For SRs that existed prior to Amendment [- ], including SRs with modified acceptance criteria and SRs whose intervals of performance is being extended, the first performance is due at the end of the first surveillance interval that begins on the date the Surveillance was last performed prior to implementation of Amendment [ ]. For SRs that existed prior to Amendment [ ], whose intervals of performance are being reduced, the first reduced surveillance interval begiis upon completion of the first surveillance performed after implementation of Amendment [ ].

Appendix D of the Facility Operating License, NPF-35 and NPF-52, should be revised to include the following additional paragraph:
