ACCEPTANCE REVIEW OF LICENSE AMENDMENT REQUEST TO REDEFINE LICENSED AREA OF THE CIMARRON FACILITY - SPECIAL NUCLEAR MATERIAL LICENSE SNM-928

Dear Mr. Halliburton:

The U.S. Nuclear Regulatory Commission (NRC) staff received Environmental Properties Managements (EPM) November 22, 2019, request to amend special nuclear materials license SNM-928 to redefine the licensed area of the Cimarron site near Crescent, Oklahoma (Agency wide Documents Access Management System (ADAMS) Accession No. ML19330E146). At the NRC staffs request, EPM provided supplemental information by letters dated February 24, 2020 (ADAMS Accession No. ML20057F594), and March 24, 2020 (ADAMS Accession No. ML20087H742). The NRC staff has completed its administrative review and accepts the license amendment request for detailed technical review.

The NRC staff has prepared a schedule for review of this amendment request. The schedule shown below is based on several assumptions:

  • There is no hearing on the amendment request.
  • Timely resolution of any issues or concerns raised during consultations with other Federal, State, tribal, and local agencies, such as those required by Section 7 of the Endangered Species Act of 1973 and Section 106 of the National Historic Preservation Act of 1966, including any issues that could delay completion of the cultural resources survey.
  • The number and complexity of comments provided by the State of Oklahoma does not require more time and effort than anticipated for resolution.
  • No lapse in appropriations for the NRC or other cooperating or consulting agencies.
  • EPM provides timely and high-quality responses to the NRC staff requests for additional information (RAIs).
  • EPM remains grandfathered under the Site Decommissioning Management Plan criteria.
  • There are no major modifications to the amendment request.

B. Halliburton The schedule for the NRC staff review is as follows:

Finalize Safety Evaluation Report 11/16/2021 Issue Amended License 11/23/2021 The NRC anticipates EPM will commit to provide the necessary information to the NRC in accordance with this schedule, which will allow the NRC staff to complete its safety and environmental reviews by November 16, 2021, and issue the amended license by November 23, 2021. Specifically, the assumption is that EPM will adequately respond to all Safety RAIs by November 24, 2020 and all Environmental RAIs by December 11, 2020.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
