Administrative Issues Preparation of Proposed Scope of Work and Budget for 2024 EPM is beginning to develop a scope of work for its primary contractors:

Enercon Services LLC (Enercon)

Burns & McDonnell Engineering Company, Inc. (BMcD)

Veolia Nuclear Solutions - Federal Services (VNSFS)

for the time period January 1, 2024, through March 31, 2025. The scope of work will be based on the following:

All responses to Requests for Additional Information (RAIs) will be submitted before the end of 2023.

A draft SER (possibly with a draft amended license) be issued for review by June 1, 2024.

The amended license approving the D-Plan will be issued by December 31, 2024.

Our goal will be to advance all designs to issue-for-bid status, generate and send requests for proposal for all fabrication and construction, receive and select contractors, and negotiate contractual terms and conditions with selected contractors before the end of the year. That way, if we receive the amended license by the end of 2024, we will be able to obtain best-and-final pricing and execute contracts as early as possible in 2025.

The three contractors have delayed submission of detailed scope of work and cost proposals for 2024 due to their focus on preparing responses to RAIs.

EPM plans to submit the proposed scope of work and budget for 2024 by November 7, 2023.

Continuity / Succession Planning Bill Halliburton has announced that he will be retiring on or around the end of the year. John Hesemann will take over as the Trust Administrator. Jeff Lux may be ready to retire on or around the end of 2024. A transition from Jeff to Matt Crawford will begin in 2024. We are scheduling this transition to last through 2024, but that may be accelerated if needed.

At the DEQs request, EPM prepared a high-level succession plan for transitioning to a replacement for the Trustee PM, but that is being expanded upon to address the more urgent upcoming transition to the new Trust Administrator.

John Hesemann and Matt Crawford will be attending meetings and be copied correspondence.

Decommissioning Issues Response to RAIs for the Environmental Assessment The NRC issued RAIs for the EA in a letter dated September 6, 2023. There are fourteen RAIs related to:

The future use of remaining buildings that are no longer on the site.

Estimated transportation emissions.

The use of potable water and its impact to the Logan County Rural Water Districts supply.

Four RAIs are related to ecological resources.

Estimated amounts of waste generated during construction, demolition, and operations.

Four RAIs are related to permits and/or approvals.

Cumulative impacts to or due to nearby commercial or industrial facilities.

Responses are due November 6, 2023.

EPM will submit responses to these RAIs on or before November 6, 2023.

Response to RAIs for the Safety Evaluation Report The NRC issued RAIs for the SER in a letter dated October 2, 2023. There are six RAIs related to groundwater extraction and treated water injection, and in-process and post-remediation groundwater monitoring. There are four RAIs related to health physics issues.

Responses are due December 1, 2023.

A meeting was conducted on October 16th to obtain clarification of the information needed to respond to RAIs on health physics, and another meeting was conducted on October 17th to obtain clarification of the information needed to respond to RAIs on groundwater extraction, treated water injection, and groundwater monitoring.

EPM will submit responses to these RAIs on or before December 1, 2023.

RAIs Related to Nuclear Criticality Safety There will be one RAI related to nuclear criticality safety.

The NRC plans to issue the RAI for nuclear criticality safety by November 3, 2023.

Section 106 Consultation In letters dated October 9, 2023, the NRC requested concurrence from the Oklahoma Archeological Survey and the Oklahoma State Historic Preservation Office regarding the NRCs determination that seven of the eight structures presented in the September 2020 Historical and Cultural Resources Survey may be eligible for listing on the Nati onal Register of Historic Places.

What appears to be remnants of a corral is the structure that the NRC does not believe is eligible for listing.

While the information and conclusions provi ded by the NRC are being reviewed, EPM will further investigate the origin and use of three diesel pumps that are alleged to have provided water from the Cimarron River to the operating facility.

Anecdotal information indicates that the pumping stations may have been used to provide water for water-flooding by oil and gas companies to enhance the production of oil. EPM will review historical airphotos and seek information on the age of the pumps to determine if the pumps may have been used for oil production.

EPM will advise the NRC, the DEQ, and both the OAS and the SHPO if evidence is found that indicates that these pumps were used for oil production; such evidence may or may not affect their eligibility for listing.
