Oklahoma Archeological Survey November 3, 2023 THE UNIVERSITY OF OKLAHOMA U.S. Nuclear Regulatory Commission Attn : Christine Pineda Mailstop: T4-B72 11545 Rockville Pike Rockville, MD 20852 Re: OAS FY24-0035 Phase I Cultural Resources Survey of the Cimarron Environmental Response Trust Property. Report by Daniel Rodriguez, Brandy Harris, & Andrew Gottsfield (Burns & McDonnell).

Legal Description : Sections 2, 1, 11, 12, T16N, R4W, Logan County, Oklahoma .

Dear Ms. Pineda,

This agency received the above-referenced cultural resources report in association with the proposed Cimarron Environmental Response Trust project in Logan County for review and comment. From the information provided, we understand that Burns & McDonnell staff surveyed the 530-acre project Area of Potential Effects (APE) on May 5-12, 2023 . No archaeological sites or other historic resources were located within the APE . NRC recommends a finding of No Effect on Historic Properties for the undertaking.

I concur with the findings and recommendations as they pertain to precontact archaeological resources and defer opinion on the overall project effects to the Oklahoma State Historic Preservation Office.

This review has been conducted in cooperation with the State Historic Preservation Office, Oklahoma Historical Society. You must also have a letter from that office to document your consultation pursuant to Section 106 of the National Historic Preservation Act.
