Dear Sirs:

Solely as Trustee for the Cimarron Environmental Response Trust (CERT), Environmental Properties Management LLC (EPM) responds herein to a request for information from the Oklahoma Department of Environmental Quality (DEQ). In letters dated December 15, 2022, EPM provided justification for the abandonment of five monitor wells located near the Cimarron River and three monitor wells located on property which is no longer owned by the CERT.

The two letters provided different information regarding the funding for the well abandonment.

One letter (for the 5 wells located near the Cimarron River) stated that the cost for well abandonment would be accrued to 2022. The other letter (for the 3 wells on divested property) stated that the cost for well abandonment would come from the budget for 2023.

EPM submitted a proposed scope of work and budget for 2023 to the U. S. Nuclear Regulatory Commission (NRC) and the DEQ on December 1, 2022. The proposed scope of work included a category entitled Redox Evaluation, BA1 Extraction Trench Evaluation, and Site Maintenance.

The description for the Site Maintenance portion of this category read, Contract for and oversee maintenance of site, including site mowing, maintaining access to monitoring wells and environmental dosimeters, and other site maintenance activities as needed.

Burns & McDonnell was requested to provide a cost estimate for this site maintenance category, and the more detailed description of work to be performed included, Contract for and provide on-site supervision of the plugging and abandonment of up to eight monitor wells.

Consequently, if the NRC and the DEQ approve the proposed scope of work and budget for

  • jlux@envpm.com 2023, funding for the abandonment of all eight monitor wells will be allocated to Task 4, Site Decommissioning. The cost for monitor well abandonment will come from both the Federal Environmental Cost Account and the State Environmental Cost Account in accordance with the allocation described in the December 1, 2022, proposed scope of work and budget.
