.'vARD ORDER OF May 3, 1985 By its order dated May 3, 1985 and served May 6, 1985 (the Order) this Board ordered Applicants to give a current construction status report. In response to this order the' Applicants provide the following information as to the status of construction on May 31, 1985:

In the Order the Board also ordered that the Applicants prepare-an " estimate for resolution of the remaining issues." All contentions other than those which may arise out of offsite emergency planning matters have now either been withdrawn, resolved by summary

-disposition, or are sub judice this Board, save one.

That one issue is the so-called DCRDR issue which is raised by Contention No. 10 of the New Hampshire Attorney General. The Applicants continue to believe that this contention will be resolved without the need for evidentiary hearings.

Contentions with respect to state and municipal emergency plans presumably will be in order for filing as soon as the plans are submitted by the Governors of Massachusetts and New Hampshire to FEMA. The best estimate we have at this time is that these submissions will occur in the Fall of 1985. On May 23, 1983 this Board issued a tentative hearing schedule for resolution of offsite energy planning issues. This schedule, if adhered to contemplates the commencement of hearings six months after the filing of the emergency plans. We believe that scheaule could be shortened by one month by reducing the time allowed for statutory contentions and discovery each by 50%. Given the wide exposure the plans 4

7 will have prior to filing it would seem that such reductions in time would be appropriate.

In addition there will have to be a resoltion of the contentions which arise, if any, out of the emergency exercise conducted for Seabrook as required by 10 CFR 50 App. E in light of the decision in UCS v. NRC __ F.2d __,

2 CCH Nuclear Reg. Rptr. 1 20,303 (D.C. Cir. 1984). That decision makes clear that the Commission has wide latitude to structure proceedings required thereby to assure resolution of contentions in an expeditious manner. The Seabrook exercise is currently scheduled for February of 1986. Allowing five months for resolution of any contentions made as a result of this exercise would result in completion of the Seabrook Operating License proceedings before this Board in or about July of 1986.
