l SAPL's NOTICE OF APPEAL OF LICENSING BOARD MEMORANDUM AND ORDER LBP-91-2~

NOW COMES the Seacoast Anti-Pollution Lnague (SAPL) and hereby appeals the decision of the Atomic Safety and Licensing Board in its Memorandum and Order of June 18, 1991, LBP-91-28.

By this Memorandum and Order, SAPL's petition to intervene in the l

proposed license transfer of Public Service Company of New Hampshire's 35.6 percent interest in the Seabrook plant to a subsidiary, (North Atlantic Energy Corporation) of Northeast Utilities was denied.

The Licensing Board held, in LBP-91-28, that SAPL lacked l

standing to raise the issue of whether the transfer of ownership

of the PSNH Seabrook interast, the largest ownership interent in the plant, to an NU subsidiary, should be authorized by the NRC.

SAPL had alieged, based on an NRC inspection report and other public information, that the ownership transfer had the potential to result in an increase in the nuclear hazard at Seabrook because of allegations, being investigated by the NRC, that NU, either itself or through its subsidiaries, had engaged in a pattern or practice of cuppressing its employees who undertook to raise safety concerns either with the NRC or the public, contrary to, ID19I A Li.<2, 10 CFR 50.7.

SAPL appeals the decision that it lacked standing to contest the license transfer on the basis of the test imony of NU employees that there is a corporate practice of harass ent and intimidation of those who bring forth safety allegatic.ns 4.ther to the NRC or the public.

SAPL has long been an admitted intervenor, both in the construction permit proceedings, and in the operating license proceedings either held, or now being held, in regard to the Seabrook plant.
