Dear Chairman Jackson:

On behalf of the industry, I want to thank you for the opportunity on March 8 to brief the Commission on our views on the Design Certification rules, particularly with respect to the issue of" applicable regulations."

l l It was clear from the discussion that the Commission is keenly aware that the l issues at hand are indeed policy and process, not public health and safety. We stand ready to meet with the staff for clarification of their views on the issues at any time. However, we remain firm in our conviction that the proposed " applicable regulations" are unnecessary and inconsistent with long-standing Commission policy.

We remain hopeful that the Commission willissue final Design Certification rules for the GE ABWR and the ABB CE System 80+ that fully realize the goals of 10 CFR 52.

We greatly appreciate the Commission's attention to this vitally important issue.
