l The Cvuuuuwealth of Pennsylvania concurs in the recotmundation of 1

I the Atomic Safety and Licensing Board that the pendency of the reopened l

1 operator cheating hearing should .lirit the restart of IMI-1 to no greater than five percent power, for the reasons stated by Dr. Little. (PID 12021).

There are inpertant public health and safety issues addreased in the I reopened proceeding that are not addressed in the license conditions in 1583 of the PID, and that should be resolved prior to full power operation.

The Comnxuealth also agrees that five percent power operation is contingent upon the enforcement of the staffing, training and testing license ccnditions in PID 1583.

The Connenwel.th enphasizes that it takes no positien at this tire on the imnediate effectiveness of the ASLB's. decision on plant design and energency planning issues. The above comnents are limited to the.
