SUPPLEMENTAL INFORMATION RELATED TO REQUEST FOR INFORMATION PURSUANT TO TITLE 10 OF THE CODE OF FEDERAL REGULATIONS 50.54(f) REGARDING SEISMIC HAZARD REEVALUATIONS FOR RECOMMENDATION 2.1 OF THE NEAR-TERM TASK FORCE REVIEW OF INSIGHTS FROM THE FUKUSHIMA DAI-ICHI ACCIDENT On March 12, 2012, the U.S. Nuclear Regulatory Commission (NRC) issued a request for information pursuant to Title 10 of the Code of Federal Regulations, Part 50 ( 10 CFR),
Section 50.54(f). The purpose of that request was to gather information concerning, in part, the seismic and flooding hazards at operating reactor sites to enable the NRC staff to determine whether your license should be modified, suspended, or revoked. The "Required Response" section of Enclosure 1 indicated that licensees should provide a Seismic Hazard Evaluation and Screening report within 1.5 years from the date of the letter for central and eastern United States (CEUS) nuclear power plants, and within 3 years for western United States (WUS) plants. For CEUS plants, the date to submit the report was extended to March 31, 2014, by 1
NRC letter dated May 7, 2013.
Licensees whose plant's current seismic design basis does not bound the reevaluated seismic hazard are screened in for further evaluation. For these plants, licensees are expected to submit an interim evaluation or interim actions taken or planned to address the reevaluated hazard where it exceeds the current design basis along with the Seismic Hazard Evaluation and Screening report by March 31, 2014. Additionally, all licensees with CEUS plants that screen in for further evaluation will also conduct an assessment (i.e., expedited approach) to identify certain plant safety enhancements that can be implemented by 2016. Subsequently, licensees with plants that screen in for further evaluation are requested to submit a seismic risk evaluation to assess the total plant response to the reevaluated hazard.
All licensees have committed to follow the Electric Power Research Institute (EPRI) Report, "Seismic Evaluation Guidance: Screening, Prioritization and Implementation Details (SPID) for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic," 2 as supplemented by the EPRI Report, "Seismic Evaluation Guidance: Augmented Approach for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic" 3 (referred to as the Expedited Approach). The NRC staff will treat the licensees that depart from the previously committed to and endorsed guidance for responding to the 50.54(f) letter as 1

screening into the next phase of expedited approach. Licensees are reminded that the expedited evaluations are to be completed by December 2014 for the CEUS plants.
During the course of stakeholder interactions regarding the hazard reevaluations, various questions were raised with respect to operability and reportability of systems, structures, and components (SSC) if the reevaluated seismic hazard is not bounded by the current seismic design basis. Similar issues were discussed in a February 11, 2013, public meeting concerning the flooding hazard reevaluations. 4 As a result, the staff issued a letter dated March 1, 2013, 5 providing the NRC staff's position and expectations for your assessment of new information resulting from the flooding hazard reevaluations. The purpose of this letter is to provide you with the NRC staff's position and expectations for your assessment of new information resulting from the seismic hazard reevaluations.
Operability and Reportability The staff considers the seismic hazard reevaluations being performed pursuant to the 50.54(f) letter to be distinct from the current design or licensing basis of operating plants. Consequently, the results of the analysis performed using present-day regulatory guidance, methodologies, and information would not generally be expected to call into question the operability or functionality of SSCs. Therefore, the results are not expected to be reportable pursuant to 10 CFR 50.72, "Immediate notification requirements for operating nuclear power reactors," and 10 CFR 50.73, "Licensee event report system."
However, as with any new information that may arise at a plant, licensees are responsible for evaluating and making determinations related to operability, and any associated reportability, on a case-by-case basis. Licensees should consider and disposition the information through their corrective action program or equivalent process. If an error is identified in the current design or licensing basis during the performance of the requested seismic hazard evaluation, the staff expects that licensees would assess the operability of the affected SSC. Additionally, licensees would need to determine if the situation is reportable pursuant to 10 CFR 50.72 and 50.73.
Licensees would also be expected to determine whether aspects of 10 CFR 50.9, concerning the requirement to provide complete and accurate information to the NRC, would be applicable.
Notwithstanding the preceding discussion, and as noted in the 50.54(f) letter, based upon the results of the review of the responses and other available information, the staff may impose additional requirements to protect against the reevaluated seismic hazard. As always, the safety of the operating plants is of paramount importance. The NRC staff will follow established regulatory processes, including the backfit rule, in determining whether additional requirements are warranted.
Interim Actions {Requested Information, Item (6))
Consistent with the 10 CFR 50.54{f) letter dated March 12, 2012, licensees are expected to provide, as part of the Seismic Hazard Evaluation and Screening report, an interim evaluation or interim actions taken or planned to address the reevaluated hazard (where it is not bounded by the current design basis). Licensees should describe the interim evaluations and actions in sufficient detail to demonstrate that the proposed actions are commensurate with the hazard 4

and will allow the NRC staff to assess their acceptability. The NRC staff will consider the appropriateness of the interim evaluations or actions in the context of a licensee's ability to demonstrate the seismic safety of the plant.
The staff has determined that the Expedited Approach provides an important demonstration of seismic margin and will result in plant safety enhancements through evaluations and potential modifications of certain core and containment cooling equipment in advance of completing the more comprehensive plant seismic risk evaluations.
Although plant safety enhancements resulting from the Expedited Approach will generally6 be implemented by December 2016 for CEUS plants and June 2018 for WUS plants, licensees should not solely rely on the Expedited Approach as their interim actions. Instead, licensees should provide, with the March 31, 2014, screening report, an interim evaluation or actions as described above to demonstrate that the plant can cope with the reevaluated hazard while the expedited approach and risk evaluations are conducted.

and will allow the NRC staff to assess their acceptability. The NRC staff will consider the appropriateness of the interim evaluations or actions in the context of a licensee's ability to demonstrate the seismic safety of the plant.
The staff has determined that the Expedited Approach provides an important demonstration of seismic margin and will result in plant safety enhancements through evaluations and potential modifications of certain core and containment cooling equipment in advance of completing the more comprehensive plant seismic risk evaluations.
Although plant safety enhancements resulting from the Expedited Approach will generallyS be implemented by December 2016 for CEUS plants and June 2018 for WUS plants, licensees should not solely rely on the Expedited Approach as their interim actions. Instead, licensees should provide, with the March 31, 2014, screening report, an interim evaluation or actions as described above to demonstrate that the plant can cope with the reevaluated hazard while the expedited approach and risk evaluations are conducted.
