Dear Mr. Blanch:

I am writing to inform you of the results of the Petition Review Board's (PRB's) decision regarding your petition of October 15, 2014, pursuant to Title 10 of the Code of Federal Regulations Section 2.206, concerning the proposed Spectra Energy 42-inch diameter natural gas pipeline that will intersect a portion of the owner-controlled property at the Indian Point power plant.

You made your first presentation before the PRB on January 28, 2015. The purpose of that meeting was to provide you the opportunity to provide clarifying or supplemental information in support of your petition prior to the PRB making its initial recommendation. Subsequent to that presentation, you were informed that the initial recommendation of the PRB was to reject your petition from further review on the basis that the staff had previously reviewed and resolved the items identified in your petition. On July 15, 2015, you made your second presentation before the PRB. The purpose of that meeting was to allow you to comment on the initial recommendation of the PRB and/or to provide supplementary information to your petition.

Following your second presentation and in accordance with NRC Management Directive 8.11, the PRB met to determine whether sufficient new information was presented to change or modify its initial recommendation. It was the conclusion of the PRB that the information presented, including all issues identified in your original petition, supplemental letters, and reports, have been reviewed and resolved by the NRC staff. As a result, the initial recommendation to reject your petition is final. This recommendation has been reviewed and approved by senior management of the Office of Nuclear Reactor Regulation. Therefore, your petition has been rejected for further review on the basis that all identified issues have been previously reviewed and resolved. Since the recommendation of the PRB is final, there will be no further consideration of your petition.

As agreed during your second presentation before the PRB, we will provide responses to the 39 questions that were included in your letter of July 27, 2015. The answers to these questions will be provided under separate correspondence.

P. Blanch I would like to close by saying that we share your interest in ensuring that the Spectra Energy pipeline, if built, will not adversely affect the safe operation of the Indian Point power plant.
