Dear Mr. Martin:

References (1) NRC Inspection Report No. 50-315/94004(DRP), which contained a Notice of Violation with regard to the activities that contributed to the reactor coolant level perturbations experienced during the draining of the Unit 1 reactor coolant system from February 16 through 18, 1994 (2) Our response to Reference 1, Letter No. AEP:NRC:1212A, dated May 2, 1994, pp. 8-9 of the Attachment In Reference 2, we committed to install a permanent design change to address Violation III in Reference 1 with regard to mid-loop reactor vessel level indication. We scheduled the installation of the permanent design change to occur during the next refueling outage of Donald C. Cook Nuclear Plant Unit 1 (presently scheduled for September 1995), and during the following refueling outage of Cook Nuclear Plant Unit 2 (presently scheduled for February 1996).

We are deferring the installation of this permanent design change on Unit 1 until the subsequent Unit 1 refueling outage, presently scheduled for January 1997. No change is being made to the schedule for Unit 2. The reason for the change in schedule for this modification on Unit 1 is that the affected equipment and areas are not accessible at power for necessary pre-design walkdowns and work plan development prior to outage start, necessitating that these essential preparation activities be part 94iiOi0334 94i028 PDR ADQCK 05000315 Q PDR

Mr. J. B. Martin 2 AEP:NRC:1212A2 of the sequence of operations to take place very early in the outage, with the potential for adverse effects on the outage schedule. Because the "temporary" reactor vessel mid-loop level transmitter that was used during this year's Unit 2 refueling outage was used with excellent results, and because we expect to see continued excellent results using the "temporary" transmitter until the permanent design change can be installed, deferral of the design change on Unit 1 was determined to be appropriate.

This letter is submitted pursuant to 10 CFR 50.54(f) and, as such, an oath statement is attached.
