FERMI 2 - NRC RECEIPT OF THE DTE ENERGY RESPONSE TO GENERICLETTER 2006-03, "POTENTIALLY NONCONFORMING HEMYC AND MT FIRE BARRIER CONFIGURATIONS" (TAC NO. MD1580)

Dear Mr. Davis:

The Nuclear Regulatory Commission (NRC) acknowledges the receipt of your response toGeneric Letter 2006-03, "Potentially Nonconforming Hemyc and MT Fire Barrier Configurations" dated June 9, 2006 (Agencywide Documents Access and Management System Accession Number ML061660087), as supplemented February 22, 2007 (ML070580135). Under oath or affirmation, you have stated that Fermi 2 does not rely on either the Hemyc or MT fire barrier system and provided documentation with regard to other 1 or 3-hour fire barriers that separate redundant safe shutdown trains located within the same fire area that have been designed and installed in accordance with current NRC guidance. Based on your response, the basis for stating that this other fire barrier has been designed and installed in accordance with NRC guidance should be maintained on site, and will be subject to inspection during the normal NRC inspection process.
