RESPONSE TO DISPUTED NON-CITED VIOLATION DOCUMENTED IN
FERMI POWER PLANT, UNIT 2 - CYBER SECURITY INSPECTION REPORT 05000341/2023402-01 WITHDRAWAL OF NON-CITED VIOLATION
Dear Peter Dietrich:
On November 13, 2023, Fermi Power Plant (FPP) provided a written response to U.S. Nuclear
Regulatory Commission (NRC) Inspection 05000341/2023402 dated October 5, 2023. The NRC
carefully reviewed FPPs response and determined that the original enforcement decision to
disposition this issue as a violation was not valid.
The disputed violation and the enclosure which documents the basis of the staffs conclusion
contains Security-Related Information, so the details will not be made publicly available in
accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390(d)(1). In
accordance with 10 CFR 2.390, Agency Rules of Practice, a copy of this letter will be made
available electronically for public inspection in the NRC Public Document Room or in the NRCs
Agencywide Documents Access and Management System ADAMS, accessible from the NRCs
website at http://www.nrc.gov/reading-rm/adams.html.
