IMPOSITION OF CIVIL PENALTY - $50,000 By EN 85-01 dated January 3,1985, the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of 50,000 to Florida Power Corporation. This action involved two violations where the licensee failed to fully implement and maintain in effect the provisions of the Comission approved physical security plan.

These violations were the result of the licensee's failure to take adequate ,

corrective actions when the problems were previously identified. 1 The licensee responded to the Notice in a letter dated March 1,1985. After consideration of the licensee's response, the staff concludes that the violations were warranted and that any mitigation of the proposed Civil Penalty is not appropriate. Accordingly, an Order Imposing Civil Monetary Penalty in the amount of Fifty Thousand Dollars ($50,000) has been issued today.

Under the terms of the Order, the licensee may within 30 days of the date of the Order pay the civil penalty or request a hearing.
