PROPOSED IMPOSITION OF CIVIL PENALTY - $100,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of ($100,000) will be issued on or about Septenber 13, 1989 to Florida Power Corporation. This action is based-on numerous violations of the environmental qualification requirements of 10 CFR 50.49. Because this enforcement action is the result of an inspection performed after the end of the first round of EQ inspections, the civil penalty is not proposed under the Modified EQ Enforcement Policy. Accordingly, the standard escalation and mitigation factors were considered and the base civil penalty of $50,000 for a Severity Level III problem has been escalated a total 100% for prior notice and past poor performance.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice September 13, 1989 Telephone Notification of Licensee September 13, 1989 The State of Florida will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
