Subjecy IMPOSITION OF CIVIL PdNALTIES - $50,000 By r.N 86-21 dated Ap ril 11, 1985. the Connission was notified of the intent of IE to issue a Non ce of Violation and Proposed Imposition of Civi.1 Penalties it the amount of Gne Hundred Thousand Dollars ($100,000) to Florida Power Carporation. This rction was based on security violations including degradation in a vital area barrier and failure to take effective compensatory measures.

The penalty was escalated for prior poor perfomance in the area of concern.

The licensee responded on May 30, 1986 and requested a meeting with the NRC.

The meeting was held on June 30, 1986 during which the licensee provided further information concerning the violations. After careful consideration of the licensee's arguments, the staff has concluded that three of the five violations did occur. However, the staff also concluded that two violations should be withdrawn and that some mitigation should be given for the licensee's prompt identification and reporting of the breached vital area barrier. Accordingly, an Order Imposing Civil Monetary Penalties in the amount of Fifty Thousand Dollars ($50,000) has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalties or request a hearing.
