l NOTICE OF VIOLATION Florida Power Corporation Docket No. 50-302 Crystal River Unit 3 License No. DPR-72 During an NRC inspection conducted on October 25 through December 5,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

Improved Technical Specification (ITS) Surveillance Requirement (SR) 3.7.5.1, requires l

verification that each emergency feedwater (EF) " manual, power operated, and i automatic valve in each water flow path and in both steam supply flow paths to the turbine-driven pump, that is not locked, sealed, or otherwise secured in position, is in the I correct position" once every 45 days. The ITS Bases for SR 3.7.5.1 states, in part, that "the valves verified by this SR include valves in the main flow paths and the first normally l closed valve in a branch line." i l

ITS SR 3.5.2.1 requires verification that each emergency core cooling system (ECCS)  !

" manual, power operated, and automatic valve in the flow path, that is not locked, sealed, or otherwise secured in position. is in the correct position" once every 31 days. The ITS Bases for SR 3.5.2.1 states, in part, that the valves verified by this SR " include valves in the main flow paths and the first normally closed valve in a branch line."

Contrary to the above, ITS requirements for valve position verifications were not met as evidenced by the following examples:

1. As of November 18,1998, motor-operated main feedwater (FW) valves FWV-34 and 35, the first normally closed valves in the branch lines connecting the A train l and B train EF discharge water flow paths to the A train and B train FW discharge water flow paths, were not verified in the correct position every 45 days and were not locked, sealed or othenvise secured in position. While electrical power was secured to the valve motor operator, the associated local manual handwheels were not locked, sealed, or otherwise secured in position.

2. As of November 23,1998, normally closed ECCS Decay Heat Removal (DH) ,

manual valves DHV-120 and 121, the isolation valves in the bypass line around '

cross-connect isolation valves DHV-39 and 40 which connect the A and B train DH pump suction water flow paths, were not verified in the correct position every 31 days and were not locked, sealed or otherwise secured in position.

This is a Severity Level IV Violation (Supplement 1).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in Licensee Event l Report (LER) '0-302/98-013-00 dated December 16,1998. However, you are required to submit a writt < statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it l to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region ll, and a copy to the l Crystal River NRC Resident inspector within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response, with the basis for your denial, to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

If you choose to respond, your response will be placed in the NRC Public Document Room (PDR). Therefore, to extent possible, the response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

In accordance with 10 CFR 19.11, you may be required to post this Notice within two working days.
