IMPOSITION OF CIVIL PENALTY - $25,000 By EN 88-33 dated April 29, 1988 the Comission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the arount of Fifty Thousand Dollars ($50,000) to Florida Power Corporation.

This action was based on a violation involving the failure to take appropriate corrective action to resolve a deficiency regarding the electrical loads placed on one of two plant emergency diesel generators (EDG).

The licensee responded to the Notice in a letter dated June 2,1988, in which the licensee admitted the violation but contended that mitigation of t'e proposed civil penalty was appropriate. After careful consideration of the licensee's response, the staff has concluded that mitigation of the proposed civil penalty by 50 percent is appropriate for ti: identification of the violation.

Accordingly an Order Imposing Civil Penalty in the amount of $25,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a nearing.
