Acceptance of Application - Emergency Plan Change to Implement NE) 99 TACs ME1304 and ME1305 Tim:

By letter dated May 12, 2009, Luminant Generation Company LLC (Luminant), submitted the proposed Emergency Plan Changes to implement Nuclear Energy Institute (NEI) 99-01, Revision 5 for Comanche Peak Steam Electric Station (CPSES), Units 1 and 2 for U.S. Nuclear Regulatory Commission (NRC) approval. Luminant submitted the request under Title 10 of the Code of Federal Regulations (10 CFR), Paragraph 50.54(q). However, NRC staff advised Luminant during discussions on May 26, 2009 that the request should have been submitted under 10 CFR 50, Appendix E, Section IV.B.(1). Luminant submitted the corrected application by letter dated May 28, 2009 and requested for NRC approval under 10 CFR 50, Appendix E, Section IV.B(1). The purpose of this e-mail is to provide the results of the NRC staffs acceptance review of this request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed request in terms of regulatory requirements and the protection of public health and safety and the environment under 10 CFR 50, Appendix E, Section IV.B(1). If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
