SUBJECT:

COMANCHE PEAK STEAM ELECTRIC STATION, UNITS 1 AND 2 -

ACCEPTANCE REVIEW OF LICENSE AMENDMENT REQUEST 07-004, REVISION TO OPERATING LICENSE AND TECHNICAL SPECIFICATIONS 1.0, USE AND APPLICATION AND 3.7.17, SPENT FUEL ASSEMBLY STORAGE TO INCREASE RATED THERMAL POWER (TAC NOS. MD6615 AND MD6616)

Dear Mr. Blevins:

By letter dated August 28, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML072490128), TXU Generation Company LP (the licensee) submitted license amendment request (LAR)07-004 that will increase the authorized core power level from 3458 megawatts thermal (MWt) to 3612 MWt for Comanche Peak Steam Electric Station (CPSES), Units 1 and 2, which is an approximate increase of 4.5 percent. The requested change is commonly referred to as a Stretch Power Uprate (SPU). The licensee also stated that the License Amendment Request (LAR) was developed based on the guidelines in Nuclear Regulatory Commission (NRC) Review Standard, RS-001, Review Standard for Extended Power Uprates.

This letter provides you with the results of the NRC staffs acceptance review of the CPSES, Units 1 and 2 SPU application. The purpose of an acceptance review is to determine whether the application contains sufficient information to allow the NRC staff to proceed with its detailed technical review, and also to ensure that the application adequately characterizes the regulatory requirements and licensing basis of the plant. Since the licensee developed the LAR based on the guidance of RS-001, the NRC staff used the guidance contained in RS-001, Revision 0, for the acceptance review. On the basis of its review, the NRC staff has determined that the licensee has provided necessary and sufficient information in the CPSES, Units 1 and 2, SPU application, for the staff to begin its detailed technical review.

M. R. Blevins If you have any questions, please contact me at (301) 415-3016.

Sincerely,

/RA/
