Acceptance of Application for Relief Request and License Amendment Request for In-service Inspection interval for the Reactor Vessel Weld Examination By letter dated March 4, 2009, Luminant Generation Company LLC submitted Relief Request (RR) No. B-9 for Comanche Peak Steam Electric Station (CPSES), Unit 1 and RR No. B-8 for CPSES, Unit 2. Relief requests B-9 and B-8 propose extension of the in-service inspection (ISI) interval for certain pressure retaining welds in the reactor vessel from 10 to 20 years per NRC approved WCAP-16168. The submittal also proposes an amendment (amendment No.09-004) to the license for CPSES, Units 1 and 2 to add a license condition for submittal of ISI information and analysis as per WCAP-16168. The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of RR Nos.

B-8 and B-9 and amendment request 09-004. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Pursuant to Sections 50.55a(a)(3)(i) and 50.55a(a)(3)(ii) of Title 10 of the Code of Federal Regulations (10 CFR), the applicant shall demonstrate that the proposed alternatives would provide an acceptable level of quality and safety, or that compliance with the specified requirements of Section 50.55a would result in hardship or unusual difficulty without a compensating increase in the level of quality or safety. Also, consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required. This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
