Dear Mr. Hicks,
By letter dated November 14, 2023 (ML23318A471), Vistra Operations Company LLC (Vistra OpCo) requested an exemption for the Comanche Peak Nuclear Power Plant and the independent spent fuel storage installation (Comanche Peak). In particular, Vistra OpCo requested an exemption from the specific requirements in 10 CFR Part 73, Subpart T, and for the definitions for the terms "Contraband" and "Time of Discovery" in 10 CFR 73.2 until the later of March 31, 2025, or 180 days after publication of the final Regulatory Guides.

Background:
By letter dated November 14, 2023 (ML23318A471), Vistra Operations Company LLC (Vistra OpCo) requested an exemption for the Comanche Peak Nuclear Power Plant and the independent spent fuel storage installation (Comanche Peak). In particular, Vistra OpCo requested an exemption from the specific requirements in 10 CFR Part 73, Subpart T, and for the definitions for the terms "Contraband" and "Time of Discovery" in 10 CFR 73.2 until the later of March 31, 2025, or 180 days after publication of the final Regulatory Guides.
Technical Basis for Request: The licensee justification for the duration of the exemption is based on the completion of the regulatory guidance and to provide the time necessary for Comanche Peak to go through the change management processes adequately to include the number of training weeks that will be required, and to allow for completion of the Comanche Peak Unit 2 outage scheduled for the Fall of 2024. However, the impacts identified by the licensee to the change management processes and training schedules appear to be generic to the nuclear industry and do not provide site-specific impacts and timelines to support the March 31, 2025, exemption duration date.
Request: Provide additional justification for delaying implementation of 10 CFR Part 73, Subpart T, requirements and for the terms Contraband and Time of Discovery to the March 31, 2025, exemption duration date. Include information regarding the site-specific impacts and the expected timeline needed to revise the security programs, procedures, and training for personnel in order to support VistraOpCos requested duration for the exemption. Alternatively, revise the exemption requested calendar date for implementation of Subpart T and the definitions of Time of Discovery and Contraband.
