In your letter you requested that the U.S. Nuclear Regulatory Commission (NRC) management encourage NRC staff to re-evaluate the most recent schedule and fast-track the issuing of a license amendment. As a beneficiary of the Cimarron Trust, we share your concern that it is in the best interest of the use of the funds from the Trust that we make the review and processing of the license amendment process as efficient as possible. I have encouraged the NRC staff to focus on the amendment request and complete the review as quickly as possible, while still maintaining a focus on safety in reviewing the technical merit of the application.

LETTER DATED APRIL 17, 2023, REGARDING THE SCHEDULE FOR THE REVIEW AND ISSUANCE OF A LICENSE AMENDMENT APPROVING FACILITY DECOMMISSIONING PLAN (DP) - REV 3

Dear Bill Halliburton:

This responds to your letter dated April 17, 2023, (Agency wide Documents Access Management System (ADAMS) Accession No. (ML23108A037)) regarding your concerns the schedule for the review and issuance of a license amendment approving Facility Decommissioning Plan - Rev 3 (the DP), provided in the acceptance letter for detailed technical review of the DP-Rev.3, dated March 30, 2023.

As you have pointed out that major portions of this application, for Rev.3 of the DP amendment, have been reviewed previously by the NRC staff; therefore, we are also hopeful that many of the issues identified in the past through various multiple requests for additional information (RAIs), comments provided as part of the pre-application audit, requests for supplemental information (RSIs) developed over the two previous revision attempts and the pre-application audit have been addressed in the body and details of the application.
