Dear Lynda Ozan:

The U.S. Nuclear Regulatory Commission (NRC) staff received your letter response, dated November 6, 2023, to the NRCs October 10, 2023, letter to you that enclosed a cultural resources survey report and provided determinations of eligibility for listing on the National Register of Historic Places ( https://www.nrc.gov/docs/ML2033/ML20336A206.pdf). In your response ( https://www.nrc.gov/docs/ML2333/ML23335A148.pdf), you concurred with the NRCs determinations and concluded that the project would have no adverse effect on the historic properties provided the NRC agrees to a condition that would ensure that Environmental Properties Management (EPM) returns the site to its pre-construction condition after the project is complete, which is consistent with commitments made in the Decommissioning Plan.

According to the Decommissioning Plan submitted to the NRC, EPM has committed to filling all trenches and appropriately grading and revegetating all exposed soils with perennial vegetation in accordance with the site stormwater pollution prevention plan (required by the Oklahoma Department of Environmental Quality) after the project is complete. This plan must be in place before EPM can obtain a stormwater permit for the project. As a result, the site would be restored to a natural state except for the presence of the Western Area Treatment Facility (WATF) building and associated support structures or equipment.

If the amendment is approved, the NRC will add a condition to the license that would require the following:

  • If archaeological artifacts are discovered during ground-disturbing activities, EPM must cease all work within 50 feet of the discovery and secure the location against further disturbance. EPM must notify the NRC, Oklahoma State Historic Preservation Officer, and Oklahoma Archeological Survey of the discovery before close of business the next working day after the discovery. If human remains, funerary objects, sacred objects, or objects of cultural patrimony are encountered, EPM must cease all activities within 50 April 6, 2024 L. Ozan 2 feet of the discovery and secure the location. EPM must notify the NRC, Oklahoma State Historic Preservation Officer, and Oklahoma Archeological Survey within one working day.
  • Upon completion of the groundwater remediation project, and except for the permanent WATF building and associated utilities and ancillary equipment, the site must be returned to pre-construction condition (for example, trenches must be filled and revegetated). This is to ensure that the project has no lasting visual effect on the National Register of Historic Places-eligible properties.

This letter documents NRC completion of the Section 106 process as outlined in the Advisory Council on Historic Preservation's regulations, Title 36 of the Code of Federal Regulations Part 800.
