Dear Recipients:
In a letter dated February 21, 2024, Environmental Properties Management LLC (EPM), solely as Trustee for the Cimarron Environmental Response Trust (CERT), submitted a response to a US Nuclear Regulatory Commission (NRC) concern. The issue raised was the potential for the injection of treated water in Injection Trench GWI-BA1-01 to generate sufficient groundwater mounding to cause groundwater to either 1) emerge from the surface between the injection trench and a drainage channel located approximately 150 feet east of the trench, or 2) discharge into the drainage channel (referred to in the February 21 submittal as an ephemeral stream).
After submitting that response, EPM discovered that the Comprehensive Analytical Data spreadsheet used to present uranium concentration data in the subject area did not contain all the analytical data that was in EPMs EQuIS database. In addition, when the Trustee Project Manager (Trustee PM) and a Radiation Protection technician (RP Tech) attempted to conduct a visual survey of the subject area, two problems were encountered:
- 1. Much of the area between the injection trench and the drainage channel was so heavily overgrown with underbrush that visual identification of emerging surface water is virtually impossible.
- 2. The drainage channel was discovered to be dammed in such a way that it is now essentially a pond that is at least a foot deep and 12-15 feet wide.
This submittal provides updated information on the concentration of uranium in groundwater in the southeastern portion of Burial Area #1 (BA1), work being performed that may clear the subject area, and the wetland survey performed in the area of the drainage channel. tabulates all the uranium concentration data for groundwater samples collected from those monitor wells in the southeastern portion of BA1. Attachment 2 is an image of the subject area. This figure was extracted from Figure GWRM 3-2 of the December 8, 2023, Response to October 2, 2023, Request for Additional Information (accession number ML23346A262). Attachment 2 categorizes recent uranium concentrations relative to the NRC Criterion (the Derived Concentration Guideline Level, or DCGL) of 180 picocuries per liter (pCi/L) and the State Criterion (the Maximum Contaminant Level, or MCL) of 30 micrograms
July 9, 2024 Response to NRC Concern Regarding Potential Seepage in Burial Area #1 Page 2 per liter (µg/L). In BA1 the mass concentration equivalent to 180 pCi/L is approximately 200
µg/L.
Review of the concentration trends for groundwater in the subject area indicates that as impacted groundwater migrates to the north, uranium concentrations have been declining in the subject area, and uranium concentrations in much of the area are not only well below the DCGL, but they may also now be below the State Criterion.
There are three monitor wells bordering the subject area (north of GWI-BA1-01) for which groundwater concentrations are near or slightly below the DCGL: Monitor Wells 02W40, 02W41, and 02W47. Unfortunately, the most recent uranium concentration data for these locations are for samples collected in 2018, 2017, and 2017, respectively. Based on the trend in uranium concentrations shown in Attachment 1, the concentration of uranium at all three locations may now be below the DCGL.
Safety-Related Impact from Injection of Treated Water shows the location of Injection Trench GWI-BA1-01 as a green dashed line. The area of concern is east of the injection trench, where blue dashed arrows indicate potential flow paths for groundwater (and treated water) during remediation activities. The locations of monitor wells north and east of the eastern end of GWI-BA1-01 are shown, along with the groundwater elevation, the approximate boundary of the flooded channel observed during the April 2024 wetland delineation activities, and the uranium concentration category for groundwater in each monitor well. Uranium concentration categories presented on this figure are:
Between the MCL and the DCGL (> MCL, < DCGL)
Greater than the DCGL (< DCGL)
As stated above, the uranium concentration categories shown in red font in Attachment 2 confirm that uranium concentrations in groundwater in much of the area now not only comply with the DCGL but are below the State Criterion.
Treated water containing uranium concentrations below the State Criterion will be injected into GWI-BA1-01. Because the injected water that will be flushing groundwater to the east, and the existing groundwater will both comply with NRC and State criteria, the injection of treated water presents no adverse impact from a radiological safety perspective.
Environmental Impact from Injection of Treated Water As discussed in the February 21 submittal, the injection of treated water into GWI-BA1-01 may result in either surface water seepage between the injection trench and the drainage channel, or in continuous discharge of water to the drainage channel.
July 9, 2024 Response to NRC Concern Regarding Potential Seepage in Burial Area #1 Page 3 EPM does not believe that either the creation of a surface water seep or the subsurface discharge of clean water to the impounded drainage channel represents an adverse environmental impact; however, NRC concerns regarding seepage or discharge to the drainage channel are recognized.
The February 21, 2024, letter proposed to have an Environmental/RP Tech conduct a visual survey of the subject area on a monthly basis, during routine radiological surveys conducted each month. However, the extremely thick undergrowth in the wooded area east of GWI-BA1-01 makes it impractical to visually observe seepage of groundwater to the surface in this area.
The ground surface slopes toward the east throughout this area, and any seepage of water to the surface would only flow to the impounded drainage channel. As a result, the continuous discharge of water into the channel would be unlikely to create a new wetland as it is already a surface water body. Consequently, EPM does not consider the seepage of groundwater to the surface in this area to create any adverse environmental impact.
EPM will request a cost estimate from Mills Construction, the company that provides mowing and brush clearing services for the site, for clearing the underbrush from the subject area. EPM will inform the NRC and the Oklahoma Department of Environmental Quality (DEQ) what it would cost to remove the underbrush and maintain the area. However, the removal of the undergrowth may present a more adverse environmental impact than the seepage of groundwater to the surface in this area.
If both the NRC and the DEQ believe that identifying seepage of groundwater to the surface is preferable to maintaining the existing undergrowth in this area, EPM will authorize Mills Construction to perform this brush clearing work.
Should the NRC or the DEQ desire additional clarification or information, EPM will be pleased to respond as soon as practical.
