- 1. My name is Myron M. Cherry and I am counsel for the Saginaw Valley et al. Intervenors. .
- 2. Attached to thia Affidavit as Attachment 1 is what I believe to be a true and correct copy of a Decem- .,
her 17, 1969 Jc.tter with two paces of attachments from P. L. ,
Ritter: house to attendees at a certain San Francisco Fuel-Rod Failure meeting, December 4, 1969. This letter came into my possession in the course of my duties as counsel '
to the National Intervenors in Docket RM 50-1.
- 3. Attached to this Affidavit as Attachment 2 are true end correct copics of Pages 4154, 4155, 4439, 4440, and 4267 of the transcript of the proceedings in Docket RM 50-1 on Wednecday, March 1, 1972.
- 4. The letter attached to this Affidavit as ,
i
. t Attachment 1 purports to summarize what transpired at the aforer entioned meeting. The fif th pace of the letter lists EXIIIDIT C 8006170 N @
+--r ,, e
-e-
the at.tendecs at the subject meetina among whom were included a representative of Westinchouse and a representa-tive of each of the other three reactor-vendors with which 4.
it is in competition.
- 5. Page 3 of the letter under the caption "R.J.
Mi 13 c2 .(Westirnhouse-NPD) " sets forth certain information with senpoet t o multi-rod transient burst experiments and certain parameters of those experiements. Of particlar ,
~ int ere st is that the letter states that Mr. Miller of . -
Westirqhouse disclosed to attendees at the meeting the in-torna] prensures listed in the letter as well as other para-motors of the nulti-rod burst experiments. Thus, a.repre-rr nf .,i ive of M< stinqhouse disclosed this information at the i n . e ml .. . r 4 , l 'H e') merot.i ng to me:mbers o f the Atomic Encryy
('omni: nion and to representatives of its competitors, includ-int! C( mbttstion 1:nqincering, Babcock & Wilcox, and General ,
1:lec t) i c.
G. In April, 1970, Westinchouse submitted WCAP report 7495-L, Volumes 1 and 2 to the Atomic Eneray Commis-sJon and claimed such reports to be proprietary pursuant to -
i h. tr at t. hat tho information contained thorcin is " custom-arily heJd in confidence." .
- 7. The information contained in Attdchhent,1 hereto under the caption "R.J. Miller (Nestinahouse-NFD) " is infor-mation, dicciocod by Westinghouse to its competitors at a
. i .
Decennin r - 4, 1969 .nceting and, thus, not " customarily hcid in confidence." It is also information which Westinghouse
/
claimn' is proprietary and customarily held in confidence by virtue of such information being embodied in the afore-mentioned WCAP reports claimed proprict'ary.
8.
On Thursday, March 2, 1972 in the National l:CCS Hearinan (Docket RM 50-1) , when the issue of disclosure of the information contained in Attachment 1 and in the afore-mentioned WCAP reports was pre, sented in the hearing, counsel .
r for Westinghouse restated its claim that the information was proprietary and that "WCAP 7495-L, Volumes 1 and 2, are documents customarily held in confidence by Westinchotse."
Sec Tr. 4439-40 and 4154-55, copies of which are attached hereto its Attachment ? . .
- 9. A comparinon of the informat. ion disclosed by
.Mr. MJ11er on December 4, 1969 with the information in the -
WCAP reports and claimed proprietary by Westinghouse at the National llearings demonstrates unequivocally that Westing-houco is making a claim of proprietary in the National IIc . rings , asserting that information is customarily held in c c.afidence, when in fact, the identical information was re]eaned to Wentinqhouse competitors intentionally and with Westinghouse knowledge some four months before the dato'of the alleged proprietary reports.

- 10. Although the WCAP reports which are the-t subject of this Affidavit are not now presently at issue in ~
the Midland proceeding, this Affidavit demonstrates that at
.] e an1 on one <,ccaninn, and a most recent occasion, Westinq-house does not customarily hold in confidence information it claims is proprietary. This information would require this Soard at a hearing (assuming it adopts the Westinghouse test) , to have Westinghouse disclose each person, firm, or corporation who received or had access to the information in the MCAP reports which are the subject of the instant Mot. ion j n orth r adequat.ely to assess the claim that the iodino spray removal documents are in fact customarily br1d in confidence.
- 11. We believe the information contained in this Affidavit demonstrates that the Weisemann affidavit '
is far from a complete, adequate or honest statement of the tien ti nohous 7 policy; and without exp3anation of the facts dincioned horrein, it may very well be that the Weisemann A f fi d.evi t- in an intentional misrep onentation. 7 CN t bU I k 4 Pron M. Chdrry '
