1. On March 18, 1971, Goveinor Docking requested that I take the appropriate legal steps lto protect the safety of the

- Kansas people and environment from any dangers associated wi.th the propoced Lyons Nuclear Waste Repository.

2 In June of 1971, the final draft of the Environmental Impact Statement for the Lyons project appeared, stating that the Lyons Repository was to be the nation's only such disposal facility.

3. It was not until August of 1970 that the Congressional funding of the proposed Lyons project was sufficiently completed '

to assure that the plan of the Atomic Energy Commission would in i

all probability be carried out.

It was not until the middle of August that I became aware j oftheexistenceofthelicensingapplicationconcerningthe Midland plants.
