5 The Mapleton Intervenors have no objection to the requested consolidation, and request only that Mr. Cherry be civen a chance to recpond (Tr. 5573).

6. Tne following denenstrate that consolidation will serve the interest of justice:

A. Counsel for Mapleton conceded on May 13, that there has been an identity of interest between Mapleton and Saginaw from the inception and that they have been working together throughout (Tr. 5569). The ainest 6,000 pace record nakes thic conclusion crystal cicar.

Mapleton coun cl. commencing frc::. the tiac these hearings reconvened in Mr. Cherry's absence. Indcod, Dr. SciccrA has seen seated cicser to napleton counsel than Mapleton's own consultant, Col. Gadler, has seen constantly passing nctes and comments to Mapleton counsel and advisin; him centinuously, and is now actually con-ducting cross-examination.

i C. Mapleton and Saginaw counscl have even alleged their identity of intercot and working rela-tionship as justi fying thei r wilful ann flagrant violation of the Board's Order with respect to the use of certain infer ation:

I do not believe there has been a violation of this order by either Mr. Cherry or by myself. Mr. Cherry and I from the very outset of my intervention in the ca:e have worked together. We have assisted each other. We have made no Occret cocu; that fact. We have sat together. We have exchanged legal material. We have exchanged scientific material.

If you read the first condition of the order it states, " Counsel for Intervenorn will not disclouc or permit to be diccioned any sue.1 docu=cnt, its content or any portion thereof except to persen: assisting ni= in preparing for the trying of this aroceeding or any continuation thereof."
