Dear Mr. Pollock:
The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.
1-2008-005) on October 26, 2007, to determine whether a security officer (SO) at the Indian Point Energy Center (IPEC) was discriminated against for raising security and safety concerns.
Based on testimonial and documentary evidence developed during its investigation, OI concluded that the SO was not subject to discriminatory acts for having raised security and safety concerns.
Based on testimonial and documentary evidence, although there were several issues regarding pay and sick leave for the SO, the NRC determined they were either administrative in nature and have happened to other licensee employees, or involved a business decision made for a legitimate reason.
