CRYSTAL RIVER UNIT 3 NUCLEAR GENERATING PLANT - ISSUANCE OF AMENDMENT APPROVING INDEPENDENT SPENT FUEL STORAGE INSTALLATION (ISFSI)-ONLY EMERGENCY PLAN, AND ISFSI-ONLY EMERGENCY ACTION LEVEL BASES MANUAL (TAC NO. L53129)
Dear Mr. Hobbs:
The U.S. Nuclear Regulatory Commission (NRC) is issuing the enclosed Amendment No. 253 to Facility License No. DPR-72 for the Duke Energy Florida, Inc. (DEF), Crystal River Unit 3 Nuclear Generating Plant (CR-3). This amendment is in response to your application dated May 25, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16146A639). This amendment revises the CR-3 license to approve the Independent Spent Fuel Storage Installation (ISFSI)-Only Em ergency Plan, and ISFSI-Only Emergency Action Level Bases Manual, after all the spent fuel has been moved from the spent fuel pool to the ISFSI. The Notice of the application was published in the Federal Register on July 19, 2016, (81 FR 46858, 46961).
As discussed in the enclosed safety evaluation, the NRC staff has reviewed the proposed changes to the CR-3 ISFSI-Only Emergency Plan and associated EAL Bases Manual, and concluded that the proposed changes meet the standards of Title 10 of the Code of Federal Regulations (10 CFR) Section 50.47, "Emergency plans," and the requirements of Appendix E, "Emergency Planning and Preparedness for Production and Utilization facilities," to 10 CFR Part 50, as exempted, and continue to provide reasonable assurance that adequate protective measures can and will be taken in the event of a radiological emergency at the CR-3 site.
Therefore, DEF's proposed changes, as outlined in the letter referenced above, are considered acceptable. The basis for our conclusion is contained in the attached safety evaluation.
The Commission's regular biweekly Federal Register notice will include the Notice of Issuance of this amendment.
