1. That I am an Assistant Attorney General and as an attorney for' Frank J. Kelley, Attorney General of the State

, of Michigan.

2. That the Nuclear Regulatory Ccmmission has asserted on several occasions that it has exclusive jurisdiction over the operating conditions of nuclear facilities in Michigan.  !

3. That, if the State of Michigan is to have any voice in the operating conditiors of the Midland plant, it must be granted l leave to intervene. l

4. That allegations of fact contained in the attached petition are true to the best of my knowledge except for those allegations made upon information and belief and

as to them I believe them to be,true.
