TN0026450 - AGREED ORDER NO. 89-3036 On January 18, 1990, TVA and the Tennessee Department of Health and Environment-the precursor to your department-entered into Agreed Order No. 89-3036. That order required TVA to operate its Sequoya Nuclear Plant in compliance with NPDES permit TN0026450 and the Clean Water Act; pay the State of Tennessee a monetary amount of $2,091.97; and prepare and submit a plan that details proposed systems and procedures for protecting fish and aquatic life. Soon after the effective date of the order, TVA paid the monetary amount and it developed and implemented an operating procedure for providing a fish refuge in the plant's intake embayment. In addition, the plant continues to operate in compliance with its NPDES permit and applicable provisions of the Clean Water Act. |
