UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 Thomas Marshall, Site Vice President Tennessee Valley Authority Sequoyah Nuclear Plant P.O. Box 2000 Soddy Daisy, TN 37384
SUBJECT:
REQUEST FOR ADDITIONAL INFORMATION - AUGUST 4, 2022, EXEMPTION REQUEST FOR DEVIATING FROM THE CONDITIONS OF CERTIFICATE OF COMPLIANCE NO. 1032, AMENDMENT NO. 3, RELATED TO SEQUOYAH NUCLEAR PLANT INDEPENDENT SPENT FUEL STORAGE INSTALLATION
Dear Thomas Marshall:
By letter dated August 4, 2022 (Agencywide Documents Access and Management System
[ADAMS] Accession No. ML22216A078), as supplemented by letters dated December 19, 2022 (ML22353A066), and April 27, 2023 (ML23117A116), Tennessee Valley Authority (TVA) submitted to the U.S. Nuclear Regulatory Commission (NRC) an exemption request for the Sequoyah Nuclear Plant (SQN) Independent Spent Fuel Storage Installation (ISFSI),
in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 72.7, Specific exemptions, from the requirements of 10 CFR 72.212(a)(2), 72.212(b)(3), 72.212(b)(5)(i),
72.212(b)(11) and 72.214. Specifically, the exemption request would, if granted, permit SQN ISFSI to deviate from conditions of the NRC Certificate of Compliance No. 1032, Amendment No. 3 (ML17214A039), Appendix B, Section 3.3, "Codes and Standards."
In connection with the review, the NRC staff identified that additional information is needed before a decision can be made on the request. On October 30, 2023 (ML23304A146), the NRC staff conducted a conference call with TVA representatives for the purpose of clarifying the draft request for additional information (RAI) to ensure that it was clear before formal issuance to TVA. These draft RAI questions were previously sent to TVA by email on September 26, 2023. TVAs response to the staffs RAI, as specified in the enclosure, should be provided to the NRC within 60 days from the date of this letter.
Please reference Docket No.72-034 and Enterprise Project Identifier No. L-2022-LLE-0027 November 8, 2023
