DPR-24 and DPR-27 Withdrawal of License Amendment Request 247 Spent Fuel Pool Storage Criticality Control By letter dated December 21,2006, Nuclear Management Company, LLC (NMC) requested a proposed change to the Point Beach Nuclear Plant (PBNP) spent fuel pool (SFP) criticality analysis methodology and conforming Technical Specification changes to credit soluble boron and fuel storage patterns in lieu of BoraflexB for the SFP.

These changes would also have removed the need for the currently held exemption from the requirements of 10 CFR 70.24 in that PBNP would subsequently comply with the requirements of 10 CFR 50.68.

Subsequent to submittal of the application, NMC identified errors in its application. The discrepancies were documented in the PBNP corrective action program. The NRC Project Manager was informed by the PBNP staff about the errors and the need for the analyses to be corrected.

On August 9, 2007, a conference call was held between representatives of NRC and NMC PBNP. The purpose of this conference call was to provide NMC with NRC staff insights and concerns raised during the review of similar license amendment requests submitted recently by other plants. As a result of the conference call, NMC has determined that a supplement to the License Amendment Request could not be submitted before mid-October 2007.

Document Control Desk Page 2 Accordingly, NMC has decided to withdraw this proposed license amendment. It is NMC's intention to resubmit this license amendment request in its entirety later this year when the technical issues associated with the new criticality analyses have been resolved.

This submittal contains no new commitments or revisions to existing commitments.
