Enclosed with out letter dated May 10, 2001 (NRC 2001-03 1) was a special report for Point Beach Nuclear Plant (PBNP), Unit 1 and Unit 2. The report was provided in accordance with the PBNP Fire Protection Evaluation Report (FPER), Section 8.1.5. That section requires the submittal of a special report to the U.S. Nuclear Regulatory Commission when degradation of fire protection systems or components, including an inoperable fire barrier, exceeds the time listed in FPER Section 8.1.3. As discussed in the enclosure to that letter, we reported the discovery of a degraded fire damper in the barrier that separates the 8'-0" elev. of the primary auxiliary building from the 26'-0" elev. of the south service building (damper M-5-4-1-G).

In addition to a description of immediate compensatory measures we initiated upon discovery of this condition, we also provided our plans for correcting this condition. At that time, we were evaluating a modification to restore the damper to its original condition. We have subsequently completed a fire protection engineering evaluation (FPEE-1999-009, Revision 1, dated April 29, 2002), which evaluates the acceptability of HVAC ducts that pass through Appendix R credited fire barriers without fire dampers installed. This evaluation was conducted in accordance with the guidelines of Generic Letter 86-10, "Implementation of Fire Protection Requirements," and included an assessment of damper M-5-4-1-G. This evaluation determined that the duct passing through this penetration provides protection adequate for the hazard posed. Based on the conclusion of this evaluation, we have determined that no corrective modifications are necessary for this penetration damper.
