LICENSE TERMINATION PLAN FOR THE VALLECITOS BOILING WATER REACTOR LICENSE DPR REQUEST FOR ADDITIONAL INFORMATION (EPID L-2023-LLA-0138)

Dear Scott Murray:

By letter dated September 7, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23250A267), as supplemented by letter dated September 15, 2023 (ML23261A591) and e-mail dated October 31, 2023 (ML23304A300), GE - Hitachi Nuclear Energy Americas, LLC (GEH) submitted a license termination plan for the Vallecitos Boiling Water Reactor (VBWR) in support of a request to terminate NRC license DPR-1.

To support the U.S. Nuclear Regulatory Commission (NRC) staffs technical review of the LTP approval request pursuant to the regulations in Title 10 Code of Federal Regulations (10 CFR)

Part 50, please provide the additional information described in the enclosure. The NRC developed this set of requests for additional information (RAI) using the regulations in 10 CFR 50.82(a), 10 CFR 20.1501(a) and (b), and the related guidance in NRC Regulatory Guide 1.179, Revision 2, Standard Format and Content of License Termination Plans for Nuclear Power Reactors, NRC NUREG-1700, Revision 2, Standard Review Plan for Evaluating Nuclear Power Reactor License Termination Plans, NRC NUREG-1757, Volume 2, Revision 2, Consolidated Decommissioning Guidance - Characterization, Survey, and Determination of Radiological Criteria, NUREG-1575, Multi-Agency Radiation Survey and Site Investigation Manual (MARSSIM), and NUREG-1507, Rev. 1, Minimum Detectable Concentrations with Typical Radiation Survey Instruments for Various Contaminants and Field Conditions in its review of the application.

By e-mail dated October 31, 2023 (ML23307A089), the NRC accepted the GEH proposed LTP for review. At that time the NRC staff expected that its review of the LTP would take approximately 6 months from the date the application was accepted into ADAMS or an estimated completion date of April 30, 2024, to complete its review. However, due to the need to complete an Environmental Assessment that schedule has been extended to September 16, 2024.
