RESPONSE TO NOVEMBER 10, 2023, ERWIN CITIZENS AWARENESS NETWORK CORRESPONDENCE REGARDING THE NUCLEAR REGULATORY COMMISSION REVIEW OF THE NUCLEAR FUEL SERVICES LICENSE AMENDMENT REQUEST (DOCKET NUMBER: 070-143)

Dear Linda Cataldo Modica:

The U.S. Nuclear Regulatory Commission (NRC) staff is in receipt of your email received on November 10, 2023, regarding the Nuclear Fuel Services request to amend Special Nuclear Material license (SNM-124) to include a Uranium Purification and Conversion Service in Erwin Tennessee. The NRC staff recently completed its environmental review, the Finding of No Significant Impact was published in the Federal Register (FR) on October 6, 2023 (88 FR 76262) and Environmental Assessment (EA) was made publicly available and can be found under Agencywide Documents Access and Management System ML23299A062.

The NRC performs its environmental reviews in accordance with Title 10 of the Code of Federal Regulations Part 51 and supporting guidance in NUREG-1748 Environmental Review Guidance for Licensing Actions Associated with NMSS Programs. Consistent with NRCs regulations and guidance, a draft EA was shared with the State (of Tennessee) for review and comment to fulfill its obligations under the National Environmental Policy Act. In addition, the draft EA was also shared with the U.S. Fish and Wildlife Service, which the NRC staff is required to consult with under Section 7 of the Endangered Species Act.
