AMENDMENT 20 - APPROVAL OF PHYSICAL PROTECTION PLAN, REVISION 26 (ENTERPRISE PROJECT IDENTIFIER L-2023-SPR-0002)

Dear Timothy Knowles:

This refers to letter 24Y-23-0002, dated May 15, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23146A186 - enclosures not publicly available due to the classified information contained therewithin), in which Nuclear Fuel Services, Inc. (NFS) submitted proposed changes to NFS Site Security Physical Protection Plan (PPP), Revision 26, for special nuclear material (SNM) license number SNM-124. The enclosures to the letter described, justified, and tracked the proposed PPP changes.

The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the request.

The NRC has determined that the proposed changes to the PPP are acceptable, and issuance of this license amendment will not significantly impact the public health and safety and the environment, will not be inimical to the common defense and security, and will not endanger life or property or the common defense and security.

Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Sections 70.32(e) and 70.34, Safeguards Condition SG-3.1 of Materials License SNM-124 is hereby amended to reference Revision 26 of the PPP, submitted by letter dated May 15, 2023.

All other license conditions shall remain the same. Enclosures 1 and 2 to this letter provide the amended Materials License SNM-124. The NRC staffs review is documented in a Safeguards Evaluation Report, which is Enclosure 3 to this letter. This letter concludes action on this submittal, and Enterprise Project Identifier L-2023-SPR-0002 is considered CLOSED.

Enclosures 2 and 3 contain sensitive security-related information. Accordingly, they are marked as Official Use Only, and are withheld from public disclosure. When separated from the sensitive enclosures, this letter and Enclosure 1 are decontrolled and publicly available, in accordance with 10 CFR 2.390 of the NRCs "Agency Rules of Practice and Procedure."

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and Enclosures 1 and 4 will be available for public inspection in the NRC Public Document Room (PDR) or Documents transmitted by this letter contain Security-Related Information. When separated from Enclosures 2 & 3, this letter and Enclosure 1 are decontrolled.
