RESPONSE TO AUGUST 22, 2023, ERWIN CITIZENS AWARENESS NETWORK CORRESPONDENCE REGARDING THE NUCLEAR REGULATORY COMMISSION REVIEW OF THE NUCLEAR FUEL SERVICES LICENSE AMENDMENT REQUEST (DOCKET NUMBER: 070-143)

Dear Barbara ONeal:

The U.S. Nuclear Regulatory Commission (NRC) staff is in receipt of your email received on August 22, 2023, regarding Nuclear Fuel Services (NFS) license amendment request (LAR)

(Agencywide Documents Access and Management System (ADAMS) ML23244A015). The NRC staff is currently reviewing NFS LAR, which proposes to add the U-Metal project to its Part 70 special nuclear materials license, SNM-124 (ADAMS ML21327A099).

The NRC is required to consult with the U.S. Fish Wildlife Service under Section 7 of the Endangered Species Act (ESA) regarding threatened and endangered species that may be affected by a proposed project. The Appalachian Elktoe (Alasmidonta raveneliana) will be considered in the NRC staffs environmental review of the proposed LAR, which will include consultation under Section 7 of the ESA. The results of the Section 7 ESA consultation will be documented in the NRC staffs environmental review. Once complete, those results will be made publicly available.
