Dear Sir:

21 G-24-0192 GOV-01-55-04 ACF-24-0219 October 9, 2024 In the aftermath of the recent 2024 weather event, only one (1) off-site air sampling location was physically destroyed, and commercial power will remain unavailable.

Other off-site sampling locations impacted by the weather event have been fully restored and verified operational. As such, for this single location, NFS requests the following as a temporary license condition during this time of recovery. Given the significance of this event and time sensitive nature, NFS requests a high priority review and expedited approval by Wednesday, October 16, 2024, to support a safe return to operations.

Notwithstanding the commitments in Chapter 9 of the SNM-124 license application, NFS shall implement compensatory measures, as stated in the letter dated October 9, 2024, for the air sampling location that was significantly impacted by the 2024 weather event. In accordance with Chapter 9 of the license application, NFS has documented this condition in the Corrective Action Program.

This condition shall remain in effect for one (1) year or until such time commercial power is restored near the original sample location.

As described in Chapter 9 of the license application, it is important to note, the subject air sample locations are "in addition to" those required to maintain full compliance with the requirements in 10 CFR Part 20. This request does not reduce the effectiveness of the NFS effluent monitoring program as all NRC required on-site sampling remains in operation.
