RESPONSE TO THE SEPTEMBER 26, 2023, LETTER FROM YOGEV VON KUNDRA REGARDING THE U.S. NUCLEAR REGULATORY COMMISSION REVIEW OF THE NUCLEAR FUEL SERVICES LICENSE AMENDMENT REQUEST (DOCKET NUMBER: 070-143)
Dear Yogev Von Kundra:
The U.S. Nuclear Regulatory Commission (NRC) staff is in receipt of your letter dated September 26, 2023, (Agencywide Documents Access and Management System ML23279A117) regarding the Nuclear Fuel Services (NFS) license amendment request (LAR),
which requests NRC approval to add the uranium purification and conversion (U-Metal) project to its Part 70 special nuclear materials license, SNM-124 (ML21327A099). You stated that the NRC should publish an environmental assessment or environmental impact statement before making a decision on the LAR.
The NRC staffs process for evaluating a LAR includes a safety review, which is documented in a safety evaluation report, and an environmental review. The NRC staff determines the level of environmental review based on NRCs regulations implementing the National Environmental Policy Act, which can be found in 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. NRCs regulations in 10 CFR 51.21, Criteria for and identification of licensing and regulatory actions requiring environmental assessments, states that all licensing and regulatory actions subject to an environmental review require an environmental assessment, except those identified in 10 CFR 51.20(b) as requiring an environmental impact statement, or those identified in 10 CFR 51.22(c) as categorical exclusions, and those identified in 10 CFR 51.22(d) as other actions not requiring environmental review.
Based on NRCs regulations in 10 CFR 51 and related guidance, the NRC staff determined that preparing an environmental assessment was appropriate to evaluate the potential environmental impacts from the proposed U-Metal project. NRC issued the environmental assessment on October 26, 2023 (ML23299A062). The safety evaluation report will be issued in November 2023. Both evaluations will provide the bases for the NRCs decision whether to grant the LAR.
