SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT N05.114,30 ,141, AND 33 TO DPR-61, DPR-21, DPR-65, AND NPF-49 CONNECTICUT YANKEE ATOMIC POWER COMPANY AND NORTHEAST NUCLEAR ENEPGY COMPANY, ET AL.

HADDAM NECK PLANT AND MILLSTONE NUCLEAR POWER STATION, UNIT NOS. 1, 2 AND 3 DOCKET NOS. 50-213, 245, 336 AND 423 a INTRODUCTION By application dated January 12, 1989, Connecticut Yankee Atomic Power Company and Northeast Muclear Energy Company (the licensees) requested changes to the Technical Specifications (TS) for Haddam Neck and Millstone Units 1, 2 and 3.

The amendment to the TS will add a new requirement to TS Section 6.7, " Safety Lim lt Violation." This requirement will state that if any safety limit is exceeded " operation shall not be resumed until authorized by the Commission."

This change will make the TS for the four plants consistent with the requirements of 10 CFR 50.36, " Technical Specifications." In addition, an amendment to the Millstone Unit No. 3 TS will change the requirement for auditing TS compliance from all provisions in each section to provision in each section, each year, during the five-year audit cycle.

EVALUATION The proposed change to TS Section 6.7 will add a new requirement on the licensees if a plant exceeds a safety limit. In that case, the licensee will not be able to restart the affected plant until the Concission authorizes that action. This change to the TS of the four plants directly incorporates a reovirement from 10 CFR 50.36, " Technical Specifications," and, as such, is an acceptable change.

The proposed change to Millstone Unit No. 3 TS Section 6.5.3.7. ' Audits,"

involves deleting the requirement for auditing TS compliance frein all provisions in each section, to provisions in each section, each year, during the five-year audit cycle. All sections of the TS and the license are audited each year; however, all items in each section need not'be audited annually.

Over the five-year audit cycle, the audits will address each item in the sections, subsections and tables. In previous TS amendments (Amendment No. 79 for the Haddam Neck Plant, Amendment No. 96 for Millstone Unit No. I and Amendment No. 93 for Millstone Unit No. 2) the NRC granted similar changes for 8905030627 890425 fDR ADOCK 05000213 mC i

-2 the other three plants. These amendments conformed more closely with the recommendations of the Standard Technical Specifications. This change for Millstone Unit No. 3 will bring this TS into conformance with the TS for the other three plants. Based on the conformance of this request to previous authorized amendments the staff finds this change to be appropriate and acceptable.

ENVIRONMENTAL CONSIDERATION The amendments for Haddam Neck ant. Millstone Units 1, 2 and 3 involve changes which are administrative in nature. Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 551.22(c)(10). Pursuant to 10 CFR 951.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

CONCLUSION We have concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the will not be endangered by operation in the proposed manner, and (2) public such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
